Whereas, in the case of certain types of motor street cars, specially those of the 1100 and 1200 type, frost accumulates on the front windows in the motorman's vestibule and thereby impedes the safe operation of the car and tends to increase the number of accidents; now, therefore

Be it resolved by the council of the city of Cleveland: That the city street railroad commissioner take up with The Cleveland Railway Company the question of providing some means of preventing the unusual accumulation of frost on windows of the motorman's vestibule on certain types of motor cars.

EMERGENCY RESOLUTION

File No. 46023. Mr. Michell. Whereas, an emergency exists by way of providing for the usual daily operations of a municipal department, to-wit: providing for the printing of the first reading ordinances for the use of council; now, therefore

Be it resolved by the council of the city of Cleveland, state of Ohio: That the clerk of council is hereby authorized and directed to enter into a contract for printing first reading ordinances for the year 1918 with S. J. Monck at the rate of 70 cents per page for 100 copies and 50 cents per page for each additional 100 copies, in accordance with his bid received December 8, 1917.

This resolution is hereby declared to be an emergency measure and shall take effect from and after its adoption and approval by the mayor. Read first time.

Whereas, the council has learned of the death of Thomas B. Flower, formerly a member of this body; and Whereas, the services rendered by Mr. Fewer to the city of Cleveland were characterized by close and faithful attention to duty; now, therefore

Be it resolved by the council of the city of Cleveland, state of Ohio: That we express our sympathies to the members of his family and that a copy of this resolution be spread in full on the minutes of this council and a copy be sent to the family. Adopted by a rising vote.

ADOPTED RESOLUTIONS AND ORDINANCES

Whereas, the employees of the United States post office department are seeking an increase in salaries; and

Whereas, the post office employees of Cleveland have made an appeal to the public of this city by presenting to the public the facts of the case; and

Whereas, in the opinion of the council of the city of Cleveland the post office employees have made their case and ought to receive a substantial increase in pay, because their claim is just and fair, and, secondly, because it seems necessary for the efficiency of the postal service both now and in the future; now, therefore,

Be it resolved by the council of the city of Cleveland, state of Ohio: That in the name of its people the request of the postal employees for an increase in pay be endorsed and that we send word to the post master general that in the opinion of the council of the city of Cleveland the people of Cleveland who use the post office believe that a substantial increase in pay should be given to the postal employees; and

Be it further resolved, that a copy of this resolution be sent to the United States senators from Ohio and to the congressmen from the local districts. Adopted December 10, 1917. W. F. THOMPSON, President of the Council.

Whereas, the various city departments mail city reports and documents to libraries and similar departments of other cities; and

Whereas, it is desirable that this work be centralized to avoid duplication and waste and to make more certain the prompt distribution of city documents; and

Whereas, the municipal reference library of the Cleveland public library is willing to take charge of this work; now, therefore,

Be it resolved by the council of the city of Cleveland: That the work of the distribution of reports and documents of the city is hereby delegated to the municipal library. The clerk of council is hereby authorized from time to time to furnish to the municipal reference library such amounts of postage and express charges as may be required for the distribution of public documents. Be it resolved by the council of the city of Cleveland, state of Ohio: That the director of public safety be and he is hereby requested to have a survey made of all the dangerous corners, turns and bends in the streets of the city of Cleveland and also to report to the council the estimated cost of equipping all places dangerous to traffic in the city of Cleveland with colored reflectors or other safety signal device. Ord. No. 45877.

To grade, drain, curb, pave and improve with paving brick on concrete, Caine ave. S. E., from E. 131st st. to city limits.

Section 1. Be it resolved by the council of the city of Cleveland, state of Ohio: That it is necessary and conducive to the public health, convenience and welfare that Caine ave. S. E., from E. 131st st. to city limits, be improved by grading, draining, setting curbs, paving with paving brick on concrete, and improving to the established grade, in accordance with the plans, specifications and profiles, on file in the office of the director of public service, division of engineering, and with the estimated cost as shown by assessment report No. 4820, all of which are hereby approved.

Sec. 2. That the entire cost and expense of this improvement, less the cost of improving street intersections and one-fiftieth (1-50) of the entire cost exclusive of street intersections, shall be assessed upon all the lots and lands abutting upon said Caine ave. S. E., between E. 131st st. and city limits, in proportion to the benefits which may result from said improvement and it is hereby determined that said lots and lands are especially benefited by said improvement. The director of public service has fixed 15 years as the estimated life of the improvement.

Sec. 3. That the assessments so to be levied shall be paid in five (5) annual installments with interest on deferred payments at five (5) per cent per annum; provided that the owner of any property assessed may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing ordinance.

Sec. 4. That any street railroad company owning or operating any street railroad upon any portion of said street, between the points aforesaid, shall, upon notice from the director of public service, be required to grade, pave and improve at its own expense, a space seven (7) feet in width for a single track and seventeen (17) feet in width for a double track, said work to be done under the direction and to the acceptance of the director of public service at the same time that the remainder of the improvement herein contemplated is being made, and paved with the same kind and quality of pavement as is used for the remainder of the roadway.

Sec. 5. That notes or bonds of the city of Cleveland shall be issued in anticipation of the collection of assessments by installments.

Sec. 6. That the remainder of the entire cost of said improvement, not especially assessed, including the cost of intersections, shall be paid out of the paving and street intersection fund.

Sec. 7. That the director of finance is hereby directed to cause written notice to be served upon the owner of each lot or parcel of land to be assessed, or upon the persons in whose names the same may be assessed for taxation upon the tax duplicate.

Sec. 8. That this resolution shall take effect and be in force from and after the earliest period allowed by law.

An ordinance to issue bonds in the sum of five hundred thousand ($500,000.00) dollars for the purpose of paying the city's portion for constructing sewers in various streets named herein and for procuring the real estate necessary therefor.

Whereas, at the general election held in the city of Cleveland, state of Ohio, on the 6th day of November, 1917, the question of issuing bonds of the said city of Cleveland, Ohio, in the sum of three million ($3,000,000.00) dollars for the purpose of paying the city's portion for constructing sewers and for procuring the real estate necessary therefor,

the same being an amount in excess of two and one-half (22) per cent of the total value of all property of the city of Cleveland, as listed and assessed for taxation, was submitted to the qualified voters of said city; and

Whereas, two-thirds of the voters voting at said election upon the question of issuing said bonds voted in favor thereof; and

Whereas, the subject matter herein provided for constitutes an emergency by providing for the immediate preservation of public property, health and safety and providing for the usual daily operation of a municipal department; and

Whereas, it is essential that this ordinance shall go into effect upon its passage and approval by the mayor, in order that the city may proceed at once with its publication as required by law; therefore

Section 1. Be it ordained by the council of the city of Cleveland, state of Ohio, two-thirds of all members thereto concurring, that it is deemed necessary to issue and sell bonds as hereinafter provided.

Sec. 2. That under authority of law, bonds of the city of Cleveland be issued to the amount of five hundred thousand ($5,000.00) dollars, for the purpose of paying the city's portion for constructing sewers in the following streets and for procuring the real estate necessary therefor: Arbor rd. Sec. 3. That said bonds shall be
designated as "city's portion street
improvement bonds," shall be of the
denomination of one thousand ($1,-
000.00) dollars each, shall be dated
December 1st, 1917, and shall be
drawn to mature as follows:

Ten (10) of said bonds to mature
on the first day of December, 1918,
and ten (10) of said bonds to mature
on the first day of December in each
of the next succeeding forty-nine
(49) years, the last bonds shall ma-
ture December 1st, 1967, and all of
said bonds shall bear interest from
the first day of December, 1917, at
the rate. of five (5) per cent per
annum, payable semi-annually upon
presentation and surrender of the
attached coupons signed by the city
treasurer.

Sec. 4. That said bonds shall be prepared by the director of law, signed by the mayor and director of finance, sealed with the city seal and recorded in the office of the sinking fund commission. Said bonds shall express upon their face the purpose for which they are issued, the fact that they are issued pursuant to law and ordinance, and they shall be made payable, both principal and interest, at The American Exchange National Bank in the city of New York.

Sec. 5. That the faith and credit of the city of Cleveland are hereby pledged for the payment of both principal and interest of the bonds herein before described at maturity, in accordance with the laws and constitution of the state of Ohio.

Sec. 6. That for the purpose of providing the necessary funds to pay the interest on the foregoing issue of bonds promptly when and as the same falls due, and also to create

and maintain a sinking fund sufficient to discharge the said bonds at maturity, there shall be and is hereby levied on all of the taxable property of the city of Cleveland in addition to all other taxes a direct tax annually during the years 1917 to 1967, both inclusive, in an amount sufficient to pay the interest on said bonds as it accrues and to provide a sinking fund for their final redemption at maturity.

That said tax shall be and is hereby ordered certified, levied and extended upon the tax duplicate and collected by the same officers, in the same manner and at the same time that the taxes for general purposes for each of said years are certified, extended and collected. That all funds derived from said tax levies hereby required shall be placed in a separate and distinct fund, which, together with all interest collected on the same, shall be irrevocably pledged to the payment of the interest and principal of said bonds when and as the same fall due.

Sec. 7. That this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor. Passed December 10, 1917. W. F. THOMPSON, President of the Council.

An ordinance to vacate alley extending from E. 99th st. easterly to the easterly line of the Doering subdivision, hereinafter described.

Whereas, on the 15th day of October, 1917, the council of the city of Cleveland adopted resolution No. 45335, declaring its intention to vacate alley extending from E. 99th st. easterly to the easterly line of Doering subdivision, hereinafter described; and

Whereas, a complete waiver has been signed by all property owners bounding and abutting upon said alley extending from E. 99th st. easterly to the easterly line of the Doering subdivision, and the same has been filed with the clerk of the council of the city of Cleveland; and

Whereas, the board of revision of assessments has approved the vacation of said alley, hereinafter described, as provided in section 176 of the charter of the city of Cleveland; and

Whereas, the council upon consideration is satisfied that there is good cause for the said vacation, and that it will not be detrimental to the general interest of the public and ought to be made; now, therefore,

Section 1. Be it ordained by the council of the city of Cleveland, state of Ohio, three-fourths of all members thereof concurring, that the following described alley be vacated, to-wit:

The portion of the alley lying about one hundred and thirty (130) feet north of Union ave. S. E., and extending from E. 99th st. easterly to the easterly line of the Doering subdivision.

Sec. 2. That this ordinance shall take effect and be in force from and after the earliest period allowed by law. The clerk of the council is hereby directed to notify the county auditor of the above vacation by sending him a copy of this ordi

nance.

Section 1. Be it ordained by the council of the city of Cleveland, state of Ohio: That the grade of the curb lines of Trumbull pl. S. E., from Warren st. S. E. to Trumbull ave. S. E., be and the same is hereby established at the following elevations above the city base of levels as established in conformity with section 29 of the recised city ordinances of 1907: At the north line of Warren st. S. E., each, one hundred and three and four tenths (103.4) feet; at a point one hundred (100) feet north of the north line of Warren st. S. E., each, one hundred and four (104) feet; at a point four hundred (400) feet north of the north line of Warren st. S. E., each, one hundred and three (103) feet; at the south line of Trumbull ave. S. E., each, one hundred and eight tenths (100.8) feet; and that the grade of the curb lines between the above mentioned points of elevation shall be uniform and in accordance with the profile of said place as recorded in volume 8. page 184 of profiles on file in the office of the department of public service.

Sec. 2. This ordinance shall take effect and be in force from and after the earliest period allowed by law. Passed December 10, 1917.

Whereas, the slope of the new sidewalk in front of the entrance steps to Trinity Cathedral would be dangerously steep if made to slope from the present lower step to the new curb; therefore,

Section 1. Be it ordained by the council of the city of Cleveland, state of Ohio: That permission is hereby granted to the executive committee on Trinity Cathedral, its successors or assigns, to construct and maintain an additional step within the sidewalk space along the southerly side of Euclid ave., beginning at a point approximately twenty-five (25) feet east of the east line of said E. 22nd st., and extending to a point approximately one hundred (100) feet east of the east line of E. 22nd st., the face of the additional lower most step to extend into the sidewalk space not more than two and eight tenths (2.8) feet beyond the south line of Euclid ave., and to follow the line of the present constructed steps. All as above specified to be approximately as shown on a plan referred to herein and attached to the original copy of this ordinance.

Sec. 2. As a condition of the acceptance of the terms agreed to by the executive committee of Trinity Cathedral, its successors or assigns, specified in the sections hereof, it is expressly stipulated that the additional step shall be removed and the sidewalk restored to a condition satisfactory to the director of public service by said, the executive committee of Trinity Cathedral, its successors or assigns, at its own expense, at any time upon the written demand for its removal by the director of public service upon the revocation of the grant herein provided by the said council, this right of revocation being herein retained by said council.

Sec. 3. Said, the executive committee of Trinity Cathedral, its successors or assigns, by its acceptance of the terms and conditions of this ordinance, agree to save the city of Cleveland harmless from any damage, loss or liability for injury to person or property, public or private, during the construction of the said additional step, as herein authorized to be constructed, or by reason of the presence, use and mainter ance of said additional step in Euclid ave., and the acceptance of this ordinance shall be in writing within ten (10) days after the passage thereof, and when so accepted
