FORM OF AN EXECUTION.

State of North Carolina,}

To L M Serg. of company. (Or to N O one of the consta bles of said County.)

You are hereby commanded to execute and sell so much of the goods and chattels, (or in case no goods and chattels be found,) lands and tenements of A B as will be sufficient to satisfy the sum of dollars, and forty cents your fee for this service; which sum is due from him, as appears by a judgment of our Company Court Martial entered up on the day of last. And make return of your proceedings to our next Company Court Martial to be held on the day of next, at muster ground. Given under my hand and seal, day of A. D. 18

Note. Where the execution is written on the same piece of paper that contains the judgment, it may be more brief-thus: "Execute, sell, &c.--and satisfy the above (or the within) judgment, and observe the law," &c.

OATHS.

OATH OF ALLEGIANCE TO THE STATE OF NORTH CAROLINA.

"I, A B, do solemnly swear that I will be faithful and bear true allegiance to the State of North Carolina, and to the Constitutional powers and authorities, which are now or may be established for the government thereof, and that I will endeavor to support, maintain and defend the Constitution of the said State not inconsistent with the United States, to the best of my ability and knowledge: so help me God."

OATH OF A CLERK OF THE SUPERIOR COURT.

"I, A B, do swear [or affirm] that, by myself or any other person, I neither have given nor will I give to any person or persons whatsoever, any gratuity, gift, fee, or reward, in consideration of my election or appointment to the office of Clerk of the Superior Court of Law for the county of

nor have I sold or offered to sell, nor will I sell nor offer to sell, my interest in the said office; do also solemnly swear that I do not, directly or indirectly, hold any other lucrative office in the State; and I do further swear, that I will execute the office of Clerk of the Superior Court of Law for the county of without prejudice, favor, affection, or partiality, to the best of my skill and ability: so help me God."

Note.--Clerks of the Courts of Pleas and Quarter Sessions, and Clerks and Masters in Equity, are also required to take the above oath with a suitable variation as to the style.

OATH OF COMMISSIONERS ALLOTTING A YEAR'S PROVISIONS.

"You and each of you swear, that you will lay off and allot to the petititioner, a year's provision for herself and family, according to law, and with your best skill and ability: so help you God."

OATH OF COMMISSIONERS DIVIDING AND ALLOTTING REAL ESTATE.

"You and each of you swear, that, in the partition of the real estate now about to be made by you, you will do equal and impartial justice among the several claimants, according to their several rights, and agreeably to law: so help you God."

OATH OF A CONSTABLE.

"I, A B, do solemnly swear [or affirm] that I will well and truly serve the State of North Carolina, in the office of Constable; I will see and cause the peace of the State to be well and truly preserved and kept according to my power; I will arrest all such persons as, in my sight, shall ride or go armed offensively, or shall commit or make any riot, affray or other breach of the peace; I will do my best endeavor, upon complaint to me made, to apprehend all felons and rioters, or persons riotously assembled, and if any such offenders shall make resistance with force, I will make hue and cry and will pursue them according to law, and will faithfully, and without delay, execute and return all lawful precepts to me directed; I will, well and truly, according to my knowledge, power and ability, do and execute all other things belonging to the office of a *Constable, so long as I shall continue in office: so help me God."

OATH OF A CORONER.

"I, A B, do solemnly swear [or affirm] that, in all things, I will diligently, faithfully and impartially execute the office of Coroner for the county of according to law and according to the best of my skill and ability: so help me God.”

OATH OF A COUNTY ATTORNEY.

"I, A B, do solemnly swear [or affirm] that I will well and truly serve the State as Attorney for the county of and that I will faithfully and impartially perform all the duties of my office according to law, and according to the best of my knowledge and ability: so help me God."

OATH OF A COUNTY SURVEYOR.

OATH OF A COUNTY TRUSTEE.

"I, A B, do solemnly swear [or affirm] that, according to the best of my skill and ability, I will execute impartially the off of County Trustee for the county of in all things a

cording to the law, that I will duly and faithfully account all public monies that may come into my hands, and will not directly or indirectly, apply the same or any part thereof to any other use than by law directed: so help me God."

OATH OF AN ENTRY TAKER.

"I, A B, do solemnly swear [or affirm] that I will well and impartially discharge the several duties of the office of Entry Taker for the County of according to law: so help m God."

OATH OF AN EXECUTOR.

"You swear that you believe this writing to be and contain the last will and testament of A B, deceased, and that you will well and truly execute the same, by first paying his debts, and then his legacies, as far as the said estate shall extend, or the law shall charge you, and that you will well and faithfully exe cute the office of an Executor, agreeably to the trust and confidence reposed in you, and agreeably to law: so help you God."

BOOK DEBT OATH FOR EXECUTOR OR ADMINISTRATOR.

"You, as Executor or Administrator of A B, swear that you verily believe this account to be just and true, and that there are no witnesses to your knowledge, capable of proving the de livery of the articles therein charged, and that you found the book or account so stated, and do not know of any other OF further credit to be given than what is therein given: so help you God."

OATH OF A GIVER-IN OF TAXABLE PROPERTY,

"You, A B, do swear [or affirm, as the case may be,] that this list by you delivered, contains a just and true account of all the property for which by law you are subject to pay taxes, to the best of your knowledge and belief, lands and town lots lying out of this county excepted: So help you God."

OATH OF AN INSOLVENT DEBTOR NOT WORTH FORTY SHILLINGS.

"I, A B, do swear that I have not the worth of forty shillings, sterling money, in any worldly substance, either in debts owing to me or otherwise howsoever, over and besides my wearing apparel, working tools and arms for muster; and that I have not, at any time since my imprisonment or before, directly or indirectly, sold, assigned or otherwise disposed of or made over, in trust for myself or otherwise, any part of my real or personal estate, whereby to have or expect any benefit or profit to myself, or to defraud any of my creditors to whom I am indebted so help me God."

OATH OF AN INSOLVENT DELIVERING A SCHEDULE.

"I, A B, in the presence of Almighty God, solemnly swear, profess and declare, that the schedule now delivered and by me subscribed, doth contain, to the best of my knowledge and remembrance, a full, just, true and perfect account and discovery of all the estate, goods and effects unto me any ways belonging; and such debts as are to me owing, or to any person in trust for me; and of all securities and contracts whereby any money may hereafter become payable, or any benefit or advantage accrue to me, or to my use, or to any other person or persons in trust for me; and that I, or any other person or persons in trust for me, have not land, money or stock, or any other estate, real or personal, in possession, reversion or remainder, of the value of the debt or debts with which I am charged in the execution; and that I have not, directly or indirectly,
