be condemned. agree with said Norman, his heirs or assigns, upon the price to be paid for such property or privileges, then said Norman, his heirs and assigns, are authorized to take and condemn so much land, water, and water rights, as may be necessary for the purposes of this act, under the provisions hereof, and to proceed with the use and improvement thereof in the premises, and with the construction of dams, reservoirs and other works therein as aforesaid; but the lands so condemned shall not exceed the quantity and limits hereinafter specified, to wit of lands adjoining and adjacent to said streams, and lying next to and south of, said Main Road, and between said road and Union street, so called-about What lands may twenty-three acres belonging to Susan B. Thurston, Peleg L. Thurston, Lewis Thurston, Roland Thurston and Parker H. Thurston, about twelve and a half acres belonging to John Croucher, about thirteen and threequarters acres belonging to Jacob Chase, and about sixteen and a half acres belonging to Peleg A. Coggeshall; and of lands lying near and south of said Union street, about four acres belonging to Edward Almy, and about twenty-two acres belonging to Edward Sisson; and of lands adjoining and adjacent to said Easton's Pond, for raising or increasing the capacity of said pond by flowing or otherwise, about forty acres of such lands which lie to the northward of said Norman's present dam on said pond; provided always that no person shall be deprived under this act of any right of Rights reserved. boating, fishing or cutting ice on said pond. City of Providence: Sewer taxes not and may be re funded, in certain cases. ENTITLED "AN ACT ESTABLISHING A BOARD OF PUBLIC It is enacted by the General Assembly as follows: SECTION 1. No tax now assessed and unpaid for the construction of a sewer in any street, upon any estate which does not, or some portion of which does not abut or bound upon such street, shall be collected under the provisions of said chapter, or of any act in amendment thereof or in addition thereto; and the city council is hereby authorized by ordinance, resolution or otherwise, under such conditions as it may impose, to refund any tax assessed as aforesaid and already paid to the parties paying the same. SEC. 2. This act shall take effect from and after its passage, and all acts or parts of acts inconsistent herewith are hereby repealed. CHAPTER 636. Passed May 31, AN ACT IN AMENDMENT OF CHAPTER 112 OF THE GENERAL of filling vacancy in office petroleum, etc. It is enacted by the General Assembly as follows: SECTION 1. Section 8 of chapter 112 of the General of inspector of Statutes is hereby amended, so that whenever a vacancy shall arise in the office of inspector of petroleum, kerosene and coal oil, the same shall be filled, as soon as may be, for the remainder of the year, by the town council of any town, or the city council of any city, by a new election. SEC. 2. This act shall take effect from and after the passage hereof. CHAPTER 637. AN ACT IN AMENDMENT OF AN ACT ENTITLED, "AN ACT DIVI- Passed May 31, DING THE TOWN OF EAST PROVID ENCE INTO DISTRICTS FOR It is enacted by the General Assembly as follows: SECTION 1. The annual town meeting of the town of East Providence, for the transaction of the general business of the town, shall hereafter be holden on the last Wednesday in March, in each year. SEC. 2. All acts and parts of acts inconsistent herewith are hereby repealed. SEC. 3. This act shall take effect from and after its passage. 1877. AN ACT TO ENABLE THE SEVERAL TOWNS OF THE STATE TO Passed June 1, It is enacted by the General Assembly as follows: SECTION 1. The several towns of the state are hereby authorized to appropriate and expend money in each year for the celebration of the anniversary of American independence, and of other public occasions, as follows, viz.: in towns having a population of over fifty thousand inhabitants, a sum not exceeding five thousand dollars; in towns having a population of less than fifty thousand and more than twenty-five thousand inhabitants, a sum not exceeding three thousand dollars; in towns having a population of less than twenty-five thousand and more than ten thousand inhabitants, a sum not exceeding two thousand dollars; in towns having a population of less than ten thousand and more than five thousand inhabitants, a sum not exceeding one thousand dollars; in towns having a population of less than five thousand inhabitants, a sum not exceeding five hundred dollars. Basis for ascertaining population. SEC. 2. The population of the several towns according to the last national or state census preceding the year in which appropriations are made under the provisions of this act, shall be the basis for ascertaining the population thereof. SEC. 3. All acts and parts of acts inconsistent herewith are hereby repealed. SEO. 4. This act shall take effect immediately. CHAPTER 639. AN ACT IN AMENDMENT OF CHAPTER 598 OF THE STATUTES, It is enacted by the General Assembly as follows: SECTION 1. Section 6 of chapter 311 of the Public Laws is hereby amended so as to read as follows: "The city council may by ordinance fix the salaries of city officers for the municipal year ending on the first Monday of January, 1878, and the salaries so fixed shall continue in force until changed by ordinance: provided, however, that after said first Monday of January, 1878,the sala: y of no such officer shall be increased or diminished during the municipal year for which he shall have been chosen." SEC. 2. All acts and parts of acts inconsistent herewith are hereby repealed, and this act shall take effect upon its passage. CHAPTER 640. 1877. AN ACT IN AMENDMENT OF CHAPTER 633 OF THE PUBLIC LAWS, Passed June 1, It is enacted by the General Assembly as follows: SECTION 1. Section 1 of chapter 633 of the Public Laws is hereby amended by striking out, in lines 10 and 11, of said section, the words, "if the town contains more than one thousand voters," so that the sec tion as amended shall read as follows: The "SECTION 1. The secretary of state shall prepare Book: what to and furnish to the town clerks of the several towns a contain. book to be entitled 'The Registry Book,' which book shall be ruled under suitable headings to indicate the time wher, and the place where any person desiring to be registered was born; if the person was born or had resided without the town, when he last came to reside within the state, and if he was born or has resided without the town, when he last came to reside within the town, and the place in the town at which the person resided at the time of registering." SEC. 2. Section 2 of said chapter 633 is hereby amended by striking out, in lines 4 and 5 of said section, the words, "if the town contains more than one thousand voters," and in lines 8 to 12 inclusive, the words," and the like mode of registration of persons qualified to be placed on the registry shall be made in the towns containing less than one thousand voters, but in such town the registration need only be made triennially," so that the section as amended shall read as follows: "SEC. 2. Every person who is, or within a year may be qualified to vote upon being registered and the payment of a registry tax, shall go to the town clerk of the town in which he resides, and shall annually, on or before the last day of December, register his name, and thereby certify to the truth of the facts stated in to register themselves an Registry voters nually. |
