STATED MEETING

A stated meeting of the Commission was held on this date. Present: Commissioner William R. Willcox, Chairman; Commissioners William McCarroll, Milo R. Maltbie, John E. Eustis, J. Sergeant Cram.

1] SECTION 11-A-3, FOURTH AVENUE SUBWAY-PROPOSED AGREEMENT PRO- [R. T. 4035 VIDING FOR RETURN OF CONTRACTOR'S BOND-COMMUNICATION FROM CORPORATION

COUNSEL

The Secretary presented a communication dated December 29, 1911, from G. L. Sterling, Acting Corporation Counsel, stating that the Counsel to the Commission had sent him under date of November 21, 1911, for approval as to form a proposed agreement between the City of New York, acting by the Commission, and the TideWater Building Company and Thomas B. Bryson, modifying the contract for the construction of section 11-A-3 of the Fourth Avenue Subway by providing for the return of the contractor's continuing bond, and that he did not feel justified in approving such agreement, and returning the said form of agreement with his communication. The papers were referred to the Counsel to the Commission for consideration and report. [See Proceedings of 1911; Item No. 1697.]

2] BROOKLYN BOROUGH GAS COMPANY-APPLICATION FOR APPROVAL OF [Case 1436 ISSUE OF $105,000 ADDITIONAL BONDS-HEARING ORDER

The Secretary presented a petition dated December 8, 1911, from the Brooklyn Borough Gas Company, by Richard L. Austin, asking for the approval of an issue of $105,000 additional bonds.

On motion, duly seconded, an Order in Case No. 1436 was thereupon unanimously adopted directing a hearing upon the foregoing application on January 9, 1912, at 2:30 P. M. The Chairman designated Commissioner Maltbie to conduct the hearing.
