MINNESOTA REPORTS VOL. 23 CASES ARGUED AND DETERMINED IN THE SUPREME COURT OF MINNESOTA MAY, 1876-JULY, 1877 GEORGE B. YOUNG REPORTER HARVARD LAW LIBRARY ST. PAUL WEST PUBLISHING CO. 1879 JUDGES OF THE SUPREME COURT OF MINNESOTA DURING THE TIME OF THESE REPORTS. HON. JAMES GILFILLAN, CHIEF JUSTICE. HON. JOHN M. BERRY, HON. F. R. E. CORNELL. SAMUEL H. NICHOLS, ESQ., CLERK. ATTORNEY GENERAL, HON. GEORGE P. WILSON. By Gen. St. c. 27, § 2, the Reporter is required to report all cases argued and determined in the court. By the practice of the court, based on Gen. St. c. 63, § 4, the head-note in each case is prepared by the judge writing the opinion. The cases are reported in the order of decision, and the date of decision is indicated at the head of each case. The following cases, decided during the period embraced by this volume, are omitted on account of their length, in order to make room for others of more general usefulness: St. Paul & Chicago Ry. Co. v. Brown, which holds that the title of the railway company to a large quantity of swamp lands is superior to that of the trustees of the hospital for the insane; and Dutcher v. Culver, which holds that prior to Laws 1877, c. 140, the landlord's commonlaw right of distress for rent existed in this state. They will appear in volume 24. |
