3. AND, that no Part of the aforesaid Articles of Naval at which Reports Stores may be exported without the Knowledge and Consent of the said Commissioners; IT IS HEREBY FURTHER ENACTED, That the said Commissioners shall keep an Office at some convenient Place, of which they shall give publick Notice; and that every Person who now is, or hereafter shall be the Owner or Possessor of any of the said Articles of Naval Stores within this State, shall, on or before the tenth Day of October next, for such of the said Articles as shall then be prepared fit for Use or Exportation, and within eight Days after any of the said Articles shall be so prepared at any Time thereafter, make Report to the said Commissioners, or some or one of them, of the Quantity and Quality he or she hath of all or any of the said Articles of Naval Stores, and of the Place or Places where the same are kept or stored, and at the same Time deliver a particular Invoice thereof that the same may be registered in the said Office; of which Entry or Registry the said Commissioners, or some Person by them appointed for that Purpose, shall give to such Owner or Person making the Report, a CerPersons con- tificate in Writing gratis: And, if any Person having any Stores to forfeit Pitch, Tar, Turpentine, Masts, Yards, Spars, or other Naval Stores, in his or her Possession, Custody or Care, at or after the said tenth Day of October, shall attempt to conceal or remove the same contrary to the true Intent of this Act, whether it be registered as aforesaid or not, without the Leave in Writing of the said Commissioners, or one of them, it shall be lawful for the said Commissioners, or any of them, to seize such Articles so attempted to be concealed or removed; and, on such Attempt being duly proved, the Articles so seized shall, and they are hereby declared to be forfeited to the Use of the State.

4. AND, to the End that all the Pitch, Tar, Turpentine, Masts, Yards, Spars, and other Naval Stores which now are, or hereafter shall be prepared in this State, may be the more effectually secured from Exportation, or by any Means falling into the Possession of the Enemy, Ir IS HEREBY FURTHER ENACTED, That the said Commissioners shall and may, and they and each of them are hereby fully authorized and empowered to cause all or any of the said Articles, whether purchased by them or not, to be removed at the publick Expence, to such Places of Security as they, in their Discretion, shall think

proper, in whosever Possession, Custody or Care the same may be found: And the said Commissioners are hereby directed to cause the same to be registered in the Office aforesaid, specifying the Quantity, Quality, Marks and Numbers of the Articles so removed, the Name of the Owner, and the Places from whence they were taken, and to which they are removed, and to give the Owner or Owners thereof respectively, Certificates of what they shall so take out of their Custody or Possession. PROVIDED NEVERTHELESS, That whenever any of the said Articles, or any Part thereof, shall be demanded by the Owner or Owners thereof, or by any Person duly authorized by him or them, and the said Commissioners, or any three of them, shall be of Opinion that the same may be permitted to be carried away without Danger of it's falling into the Possession of the Enemy, it shall be lawful for the said Commissioners, or any such three of them, to cause the same to be delivered to such Owner or Owners, or to his or their Order, and to permit the same to be carried away or exported from the State, any Thing herein contained to the contrary notwithstanding. And, to draw on the to enable the said Commissioners to perform the Services Treasury; and to by this Act required, the Treasurer is hereby directed to able. pay to the said Commissioners, or to any of them, out of the publick Treasury, such Sum or Sums of Money as the Governor or Commander in Chief of this State for the Time being in Council, by Warrant under his Hand, shall order, so that the same exceed not in the Whole Two Thousand Pounds; for which Sum or Sums so drawn, the said Commissioners shall account to the Council and Assembly whenever they shall be called upon for that Purpose: And the said Commissioners, on the Settlement of their Accounts, shall be allowed to retain in their Hands as a Compensation for their Trouble, at the Rate Their Wages. of Five Pounds per Centum, on all the Money they shall have disbursed by Virtue of this Act.

CHAP. LI.

An ACT to encourage the making of Salt at the Pennsylvania Salt-Works in the State of New-Jersey.

WHEREAS the Supreme Executive Council of the State of Pennsylvania, have, in Behalf of the said State, erected a Set of Works for the making of Salt near Tom's River, in the County of Monmouth, in this State, by the Name of the Pennsylvania Salt- Works, and have made Application to the Legislature to have such Men as they shall employ at the said Works, not being Inhabitants of this State, exempted from the Duties enjoined by the several Acts of this State for regulating the Militia:

Sect. 1. BE IT THEREFORE ENACTED by the Council and General Assembly of this State, and it is hereby Enacted by the Authority of the same, That it shall and may be lawful for Thomas Savage, the present Manager of the said Pennsylvania Salt-Works, and for the Manager of the said Works for the Time being, to cause to be enrolled any Number of Men that may be necessary, to be employed in and about the said Works, and to cause a Copy or Copies of such Enrolment to be delivered to the Captain or Captains of the Militia in whose District or Districts such Men shall be employed; and whenever any of the Men so enrolled shall leave the said Works, or be dismissed by the said Thomas Savage, or the Manager of the said Works for the Time being, others may be enrolled as aforesaid to supply their Places, and Notice thereof given to the Captain or Captains as aforesaid. PROVIDED ALWAYS, That the Men so enrolled be Inhabitants of the State of Pennsylvania, and not subject to the Militia Laws of this State at the Time of such Enrolment, and be bona fide employed in and about the said Salt-Works; and that they be such only as shall voluntarily consent thereto, and shall sign such Enrolment, under the Command of Officers by such Officers as shall be nominated by the said Executive and commis-Council of Pennsylvania, and commissioned by the Governor of this State.

2. AND BE IT FURTHER ENACTED by the Authority afore-ish his den with said, That the said Men so enrolled shall be furnished and Arms, &c. equipped by the said Thomas Savage, or the Manager of the said Salt-Works for the Time being, with Arms, Ammunition and Accoutrements according to the Directions of the Act, intitled, An Act for the better regulating the Militia; which Arms, Ammunition and Accoutrements, when not in actual Service, shall be lodged in a Magazine or Magazines to be kept at or near the said Salt-Works, under the Care and Direction of the Manager of the said Works for the Time being, to be used as Occasion may require: And that the Men so enrolled shall be Who are to be disciplined in Arms by being regularly mustered and exercised under the direction of the Officers so to be appointed and commissioned as aforesaid at least as frequently as by the said Act for better regulating the Militia is required and directed for the enrolled Militia of this State, under the same Fines and Forfeitures for Neglect, and to be recovered and applied in the same Manner as such Men would have been subject to for not attending Musters according to the Directions of the said recited Act, if this Act had not been made; but shall not be called away from the said Works on Musters or Reviews, nor be called into actual Service as Militia, other than by the Direction of the Manager of the said SaltWorks for the Time being, or the Officers so as aforesaid to be appointed and commissioned, for the immediate Protection and Defence of the said Works, or on an Invasion or Alarm in the Neighbourhood thereof. CHAP. LV.

An ACT for erecting Salt-Works, and manufacturing Salt within the
State of New-Jersey.

WHEREAS the great Scarcity of Salt in this and the Preamble. neighbouring States makes it necessary to erect publick Salt-Works for manufacturing that necessary Article.

Sect. 1. BE IT THEREFORE ENACTED by the Council Commissioners, and General Assembly of this State, and it is hereby Enacted by the Authority of the same, That Joseph Mullen, Lucas Schenck and Nicholas Van Brunt be, and they are hereby appointed Commissioners for purchasing a Tract or Tracts of Land in some proper and convenient Place on

the Sea Coast of this State for erecting Salt-Works and supplying the same with Fuel; and also for erecting thereon such Buildings, and procuring such Materials and Implements as may be necessary for the manufacturing Salt, and for directing the Management of the said Works.

2. AND, in order that the said Lands, with the Buildings and Works to be erected, may be effectually secured to the Use and Benefit of this State, BE IT ENACTED by the Authority aforesaid, That the said Commissioners be, and they are hereby appointed Trustees for and in Behalf of the State of New-Jersey, in whose Names the Deed or Deeds for the said Lands so to be purchased shall be taken to them, and the Survivors or Survivor of them, and their respective Heirs for-ever, in Trust for the State of New-Jersey; which Lands, when purchased, with the Works to be erected thereon, shall be and remain the Property of this State, subject to the Controul and Alienation of any future Legislature thereof: And the Deed or Deeds of Conveyance taken as above-said, shall, immediately after taking the same by the said Commissioners, be by them, after being proved, delivered to the Secretary of this State to be filed and recorded. AND BE IT FURTHER ENACTED by the Authority aforesaid, That the Commissioners, or any two of them, shall have full Power to appoint a Manager for erecting and carrying on said Works in the most speedy and effectual Manner; and such Manager to remove at Pleasure, appointing another instead thereof, when and as often as Occasion may require; which Manager, previous to his acting as such, shall take and subscribe the Oaths or Affirmations of Abjuration and Allegiance appointed by an Act of General Assembly of this State, intitled, An
