THE

PREFACE.

MANY years of agitation, and revolution, have elapsed, since it occurred to me, that the commentaries on the laws of England were barren on such legal topics, as relate to our colonies, fisheries, and commerce. The commentator was, probably, unable to obtain materials, owing to this circumstance, that the appeals from our foreign dominions lay to the king in his council, and not to the king in his Bench. There have been scarcely any reports of cases, which were decided, on such appeals, and were accessible to research; but, if such appeals had lain to the king in his bench; then would there have been many reports laid before the public, whence the commentator on the laws of England might have drawn, with an inquisitive spirit, and a liberal hand.
