The vote was taken by count, and the Tellers reported the whole number voting to be one hundred and seventy-five (175), as follows: "Yes," one hundred and seventy-five (175); "No," none (0); and the vote was declared passed by more than twothirds of the voters present and voting thereon.

Fourth Article,-"To see if the town will vote to take in fee the land in Village Square bounded by Washington street on the north, High street on the west, Walnut street on the south, (all as laid out and accepted at this meeting,) and land of the town of Brookline on the east, to be used together with the said land of the town of Brookline for the purpose of erecting an engine house thereon."

On motion of Philip S. Parker,—

Voted, That the land in Village Square bounded by Washington street on the north, High street on the west, Walnut street on the south, (all as laid out and accepted at this meeting,) and land of the town of Brookline on the east, be taken in fee to be used together with the said land of the town of Brookline for the purpose of erecting an engine house thereon.

Fifth Article,-"To appropriate thirty thousand dollars ($30,000.00) for the purpose of enabling the Selectmen to settle and pay compensation for the land voted to be taken under the fourth article."

On motion of Philip S. Parker,—

Voted, That the sum of thirty thousand dollars ($30,000) be appropriated for the purpose of enabling the Selectmen to settle and pay compensation for the land voted to be taken under the fourth article hereof.

Philip S. Parker offered the following vote,

Voted, That the Treasurer be authorized, when so directed by the Selectmen, to borrow thirty thousand dollars ($30,000) appropriated at this meeting, to settle and pay compensation for the land voted at this meeting to be taken for the purpose of erecting an engine house thereon. Bonds or notes shall be issued therefor, signed by the Treasurer and countersigned by a majority at least of the Selectmen, with interest payable semi-annually at a rate not exceeding four per centum (4%) per annum; such bonds or notes shall be dated January 1st, 1907, and shall be made payable in such annual proportionate payments as will extinguish the same in ten (10) years from their date.

The vote was taken by count, Henry Ware and Leonard C. Wason, who had previously been appointed and sworn, acting as Tellers.

The Tellers reported the whole number voting to be two hundred and nine (209), as follows: "Yes," two hundred and nine (209); "No," none (0); and the vote was declared passed by more than two-thirds of the voters present and voting thereon.

Sixth Article,—" To appropriate the sum of sixty-one thousand dollars ($61,000.00) for the purpose of building an engine house in Village Square on the easterly side of High street, between Washington and Walnut streets, and to provide temporarily for the apparatus now maintained in the present building; and to authorize the Treasurer to borrow the same."

On motion of Philip S. Parker,

Voted, That the sum of sixty-one thousand dollars ($61,000) be appropriated for the purpose of building an engine house in Village Square, on the easterly side of High street, between Washington and Walnut streets, to be erected under the direction of the Board of Selectmen and the Fire Commissioner, and to provide temporarily for the apparatus now maintained in the present building.

[An amendment offered by Emery B.Gibbs to fix the amount of the appropriation at $50,000 was rejected. An amendment offered by George S. Nyhen, fixing the amount of the appropriation at $40,000, was rejected by a rising vote, one hundred and sixty-two (162) to one hundred and thirty-two (132).]

Philip S. Parked offered the following,

On motion of Philip S. Parker,—

Voted, That the sum of six thousand dollars ($6,000) be appropriated to provide a sanitary or sanitaries in Village Square.

Eighth Article,—“ To accept and allow Atherton road, as laid out by the Selectmen and reported to the town at this meeting, and to appropriate twenty-six hundred dollars ($2600.00) for the construction thereof."

On motion of Philip S. Parker,—

Voted, That Atherton road, as laid out by the Selectmen and reported to the town at this meeting, be accepted and allowed as a townway and that twenty-six hundred dollars ($2600) be appropriated for the construction thereof.

The Selectmen reported in print the laying out of Atherton road, of which the following is a true copy.

Atherton Road.

We, the undersigned, Selectmen of Brookline, gave written notice of our intention to lay out a street substantially on the line of a private way known as Atherton road, from Summit avenue, to Winchester street, such notice requiring all persons interested to appear before us at our room in the Town Hall, on Monday, May 6, 1907, at four o'clock p. m., and caused such notice to be actually served according to law by a constable of this town at least seven days before the day so appointed for the hearing, upon Myron E. Barnes, Max Lewis, Charles S. Skinner, Eugene O'Brien, Mabel A. Pitman, Alice M. Harriman, Harriet L. Jewett (tax-title), Margaret G. Toye. Jennie Rosenfield, Jennie Thorpe, Lillian A. Masters, Annie E. Gately, trustee, George A. Burns, Griggs Land Trust, Margaret Sweeney, Thomas B. Griggs, Bradbury Co., John M. Orrock, Sadie E. Sundell, Mary L. Loveless, Elizabeth McNeilly, being all the parties known to us from whom land is taken or who may be interested in the subject-matter, and gave notice to them, and all other persons and corporations, if any, who may be in

terested in the subject-matter whose names are not known to us, by posting up true and attested copies of such notice in three public places in the town seven days at least before the day appointed for the hearing. Pursuant to such notice, we met at the time and place appointed for the hearing, and heard the remarks and objections of all persons, if any, who desired to be heard, and having viewed and examined the route of the street as hereinafter described. we do adjudge that common convenience and necessity require that said street should be laid out as a town way and it is hereby so laid out.

The land over which said street is laid out is bounded by a line beginning at a point on the northerly line of Summit avenue situated 183.40 feet westerly from its intersection with the northerly line of Beacon street; thence running westerly by said northerly line of Summit avenue 64.79 feet; thence running northeasterly by a curve to the left having a radius of 12 feet for a distance of 19.34 feet; thence curving to the left with a radius of 119.81 feet for a distance of 105.51 feet; thence curving to the left with a radius of 373.34 feet for a distance of 94.42 feet; thence running northwesterly by a tangent 225.43 feet; thence curving to the right with a radius of 1577.13 feet for a distance of 535.65 feet; thence curving to the right with a radius of 325.78 feet for a distance of 72.15 feet; thence curving to the right with a radius of 107.23 feet for a distance of 62.90 feet; thence running northerly by a tangent 19.75 feet; thence curving to the left with a radius of 20 feet for a distance of 23.37 feet to a point on the southwesterly line of Winchester street; thence running southeasterly by said southwesterly line of Winchester street 74.89 feet; thence running westerly and curving to the left with a radius of 12 feet for a distance of 24.15 feet; thence curving to the left with a radius of 67.23 feet for a distance of 36.77 feet; thence curving to the left with a radius of 285.78 feet for a distance of 63.29 feet; thence curving to the left with a radius of 1537.13 feet for a distance of 522.07 feet; thence running southeasterly by a tangent for a distance of 225.43 feet; thence curving to the right with a radius of 413.34 feet for a distance of 104.52 feet; thence curving to the right with a radius of 159.81 feet for a distance of 128.25 feet; thence running southerly by a tangent 16.10 feet; thence curving to the left with a radius of 12 feet for a distance of 17.42 feet to the point of beginning.

For a further identification of this description and location reference is hereby made to a plan and profile made by Alexis H. French, Town Engineer, dated July 14, 1906, approved by us, verified by our signatures and adopted as a part of this record.

The foregoing description has been compared with the plan and is correct.

The street having been constructed by the owners of the fee is open to the public for travel.

No awards are made. The owners of the land abutting upon said street and of the fee of the land over which said street is laid out, in consideration of the laying out and its acceptance by the town, waive

all claims to land, grade or other damages, and have contributed $920.00 towards the cost of construction.

We take land as follows:

We give the owners of land taken for the laying out of said street ten days from the date of its acceptance by the town, in which to take off their trees, fences and other property which may obstruct the building of the way.

The estimated cost of constructing the street is $3,700.00. Said street so laid out is hereby reported to the town for acceptance, and when so accepted, allowed and recorded, is to be called Atherton road. The said plan, profile, and this record are this day filed by us in the office of the Town Clerk.

Ninth Article,-"To accept and allow the alteration and widening of Hammond street, from Newton street to the boundary line between the city of Newton and the town of Brookline, as laid out by the Selectmen and reported to the town at this meeting, together with any changes of grade or discontinuance of any portion of said Hammond street made therein; to appropriate eighty-six thousand dollars ($86,000.00) to pay for land damages and the cost of construction, and to authorize the Treasurer to borrow the same; and to authorize the Selectmen to make entry for the purpose of construction before all claims for damages are finally adjusted or determined."

On motion of Philip S. Parker,—
