BOARD OF CONTROL

The regular meeting of the board of control was called to order at 10:00 a. m., Friday, July 12, 1918.

Present: Directors FitzGerald, Bernstein, Beman, Neal, Farrell and Waite.

Absent: Mayor Davis and Director Sprosty.

The minutes of the previous meeting were approved as presented, and on motion of the acting president the following resolutions were adopted:

RESOLUTIONS

Resolved, by the board of control, that contract No. 11945, with The Baldwin Bros. Co., amounting to approximately $11,600.00, covering the grading, draining and paving of E. 113th st., from St. Clair ave. N. E. to Gray ave. N. E., be and the same is hereby approved. File No. 5676.

By Director Bernstein. Resolved, by the board of control, that contract No. 11946, with Roehl Bros., amounting to approximately $8,800.00, covering the grading, draining and paving of W. 48th st., from Clark ave. S. W. to a point 535 feet northerly, be and the same is hereby approved.

Resolved, by the board of control, that inasmuch as the division of purchases and supplies has taken informal bids for steel wagon boxes for the division of garbage collection, and that the contract was awarded to the Crampton Iron Works, said company being the lowest and best bidder;

Resolved, by the board of control, that the commissioner of purchases and supplies, be and he is hereby authorized and directed to purchase the following described real estate from the owners of the parcel hereinafter stated, and needed for the widening and extending of St. Clair ave. N. E. and E. 152nd st. at their northwest intersection.

Situated in the city of Cleveland, county of Cuyahoga and state of Ohio, and known as being part of sublots Nos. 43 and 44 of J. Prouting's et al subdivision, of part of original lot No. 1, tract No. 16, Euclid township, now in the city of Cleveland, and recorded in volume 22, page 14 of Cuyahoga county records of maps, and bounded and described as follows:

Beginning at the intersection of the northerly line of St. Clair ave. N. E., sixty (60) feet wide with the westerly line of E. 152nd st. sixty (60) feet wide; thence south 72 deg. 9 min. 15 sec, west along said northerly line of St. Clair ave. N. E. forty-two and seventyfive one hundredths (42.75) feet; thence north 64 deg. 5 min. 10 sec. east nineteen and fifty-nine one hundredths (19.59) feet; thence north 51 deg. 55 min. 20 sec. east seventeen and forty-nine one hundredths (17.49) feet; thence north 22 deg. 7 min. 00 sec. east seventeen and twenty-seven one hundredths (17.27) feet; thence 11 deg. 18 min. 00 sec. east fourteen and twenty-eight one hundredths (14.28) feet to the westerly line of E. 152nd st., sixty (60) feet wide, as aforesaid; thence south along said westerly line of E. 152nd st., thirty-six and twenty-five one hundredths (36.25) feet to the place of beginning.

The consideration to be paid for the above described parcel of land is six thousand five hundred ($6,500.00) dollars.

That the commissioner of purchases and supplies be and he is hereby authorized and directed to expend an amount not to exceed six thousand five hundred ($6,500.00) for the purchase of the above described parcel of land; said money to be drawn out of the fund

The undersigned hereby makes application to the City of Cleveland, Department of Public Utilities, Division of Light and Heat, for electrical service as above and in consideration of City supplying said service, I agree to use from same all the electrical current I may require for a period of..... ....years, beginning the... ..day of.... 191...., or as soon thereafter as the said Department can reasonably and with due diligence bring its distributing system to the above premises. Said service shall in no way be used as an emergency or reserve service to any other source of supply unless so specified herein. It is agreed that notice to discontinue above service shall be in writing and filed in the office of the Department at least ten (10) days prior to date of desired discontinuance.

It is agreed that notice of material change of the connected load shall be in writing and filed in the office of the Department at least ten (10) days prior to date of said change or the undersigned will be responsible for any damage due from such change to the transformers, meters,er other equipment of the City.

It is also agreed that the City shall not be held liable for damages caused by any interruption or discontinuance of the supply of electricity, and it is also agreed that representatives of the Department shall have access at all reasonable times to the electrical equipment and appliances on the above named premises; and it is agreed that they may remove appliances and appurtenances belonging to the City for any purpose, and that upon failure to comply with any of the rules of the Department, or any of the conditions of this agreement, the City at its option may disconnect its services without notice.

I further agree to pay for the electric current for this service monthly when due, in accordance with the rate schedule and conditions as shown on the reserve side of this agreement and the Rules and Regulations of the Department and all bills not paid within the specified period shall be increased by an amount equal to 3% of the same, but in no case shall such increase be less than five (5) cents, and in default of payment thereof, the City shall have the right to discontinue service at any time thereafter without notice, and any expense incident to the discontinuance of such service, may at the City's option, be charged against my account, and such discontinuance shall further have the same force and effect in respect to the conditions on the reverse hereof as if it had been made on my written order.

It is further hereby agreed that this contract shall be binding upon my successors and assigns.

Statements shall be rendered by the Department monthly and it is agreed that no bill shall be less than $. per month from date of installation of service by the City.

This application becomes an agreement only upon authorized approval and no other agreements or modifications by any agent or solicitor shall be binding upon the City. Payments Guaranteed by.

For all consumption of 1225 units or less per month the rate will be 3c per K. W. hour, except when minimum rate applies. For consumption of more than 1225 units per month, the rate will be determined from the accompanying rate schedule, except when minimum rate applies.

These rates will be based upon the capacity of the service determined as follows: viz., the average of each week's maximum one hour K. V. A. demand over a period of one month. The demand tests to be made at least every three months by the City at its option. The K. V. A. capacity used in rendering invoice to be the next lowest to the one as determined by such tests.

CONDITIONS

The rate schedule herein, to be used in rendering monthly invoices for this contract is based upon five years of service from date of installation, and it is hereby agreed that this contract may be discontinued at any time by mutual consent in writing or upon ten (10) days' written notice by either party to the other party and by the payment of an indemnity according to the following schedule less the accrued earnings from same.

Resolved, by the board of control, that contract 11940 with The Great Lakes Dredge & Dock Co. for furnishing and driving of hard wood piling for the division of light and heat in the sum of six thousand two hundred dollars ($6,- · 200.00) be and the same is hereby approved.

Whereas, the water division of the department of public utilities is in possession of real estate which, at this time, is not needed for public use; and

Whereas, The American Ship Building Company desires to use a portion of such land not now needed for public use in connection with the construction of boats in aid of the United States government in its conduct of the present war with Germany; now, therefore,

Be it resolved by the board of control of the city of Cleveland, two-thirds of all the members thereof concurring, that the mayor of the city of Cleveland be, and he is hereby authorized to execute on behalf of the city of Cleveland a good and sufficient written lease, leasing to The American Ship Building Company, a corporation, the following described parcels of

land situated in the city of Cleveland, county of Cuyahoga and state of Ohio:

Parcel 1. Beginning at a stake which is distant one hundred thirty-two and eighteen hundredths feet (132.18') east on a line S. 87° 45' E. from the point of intersection of the south line of Division ave. with the east line of W. 45th st., beginning at said stake and running in a northerly direction along a wooden fence on a line N. 0° 25′ W. a distance of two hundred ten and five tenths feet (210.5') to a wooden fence and. turning and running in an easterly direction along a wooden fence a distance of about three hundred and forty-three feet (343′) to a fence line of fence holes used and turning and running in a southerly direction along said fence line a distance of one hundred ninetyseven feet (197') to a stake and turning and running in a westerly direction along a line S. 85° 08′ 30" W. a distance of one hundred seventy-nine and five hundredths feet (179.05') to a stake and turning and running in a westerly direction along a line S. 77° 35′ W. a distance of one hundred seventy and four tenths feet (170.40') to the point of beginning; and containing about 1.57 acres of land, be the same more or less but subject

to all legal highways.

Parcel No. 2. Also situated in the city of Cleveland, county of Cuyahoga and state of Ohio, and being that parcel of land lying between the north line of Crescent ave. N. W. and the southerly line of Division ave. N. W., and between the westerly line of W. 53rd st. and a line drawn parallel to said westerly line of W. 53rd st. and 250 feet easterly therefrom and containing about 1.52 acres of land, be the same more or less, but subject to all legal highways.

That said lease is made for the purpose of aiding the United States government in its conduct of the present war with Germany and for the further purpose of receiving a revenue from the above described land. The rental to be received from said real estate shall be two thousand dollars ($2,000.00) per annum, payable quarterly, and the written lease shall be for a term beginning June 15, 1918, and continuing during the existence of the present state of war with Germany, with the right to the lessee to remove from said premises all buildings and other improvements constructed thereon within a reasonable time after the termination of said war, and provided further that the lessee shall pay all taxes and assessments that may be levied

and assessed against said property by reason of any buildings or other improvements which may be erected or placed thereon during the term of said lease.

Resolved further, that said lease shall be prepared and approved by the director of law of the city of Cleveland, and also by the director of the department of public utilities having charge of said real estate. File No. 5687.

Resolved, by the board of control, that inasmuch as the division of purchases and supplies have taken informal bids for one elevator complete for the division of light and heat and that the contract was awarded to the Otis Elevator Co. being the lowest and best bidder;

Be it further resolved, that this resolution shall constitute the authority for the commissioner of accounts to honor the invoices covering the following:

Resolved, by the board of control, that inasmuch as the division of purchases and supplies have taken informal bids for the furnishing of lead to the division of water, and that the fluctuating market was such that it was more advantageous to buy lead in the open market, and that the contract was awarded to I. Shonberg, being the lowest and best bidder;

Be it further resolved, that this resolution shall constitute the authority for the commissioner of accounts to honor the following invoices:

Resolved, by the board of control, that the director of public utilities be and he is hereby authorized and directed to enter into contract with the Kelley Island Lime and Transport Co., lowest and best bidder, for 900 tons of lime for water purification purposes, in the sum of eight thousand five hundred and fifty dollars ($8.550.00) in accordance with its bid received July 5th, 1918.

Resolved, by the board of control, that the director of public utilities be and he is hereby authorized and directed to enter into contract with the American Steel & Wire Co., lowest and best bidder for 1,200 tons of sugar sulphate of iron for the division of water, in the sum of thirty thousand dollars ($30,000.00)

in accordance with its bid received July 5th, 1918.

Resolved, by the board of control, that resolution No. 5394, for the purchase of ($5,000) fifteen cent (15c) box lunches at thirteen cents (13c) per box, and ten thousaid (10,000) ten cent (10c) box lunches at nine cents (09c) per box and two thousand (2,000) twenty-five cent (25c) box lunches at twentytwo cents (22c) per box and eighty thousand (80,000) sandwiches at three and three-fourths cents (034c) per sandwich, from the Gem Box Lunch Co., be and the same is hereby rescinded.

Resolved, by the board of control, that the director of public service be and he is hereby authorized and directed to execute a contract, covering the furnishing of red-lead paint for Clark ave. viaduct, with the Vaughn Paint Company, the lowest and best bidder for proposition No. 1, in accordance with its bid submitted therefor on July 5th, 1918, in the approximate amount of $17,050.00.

Resolved, by the board of control, that the director of public service be and he is hereby authorized and directed to execute a contract, covering the furnishing of black paint for Clark ave. viaduct, with the National Paint & Varnish Company, the lowest and best bidder for proposition No. 2, in accordance with its bid submitted therefor on July 5th, 1918, in the approximate amount of $3,800.00. File No. 5697.

Resolved, by the board of control, that voucher for requisition No. 110-900 in payment of invoice of The White Co., Cleveland, Ohio, ambounting to sixteen hundred ($1,600.00) dollars, less allowance of three hundred and fifty ($350.00) dollars on old Krebs machine and three hundred and fifty ($350.00) on old Rpeublic machine, thereby making a net payment of nine hundred ($900.00) dollars, for one new machine delivered to the department of parks and public property. be and the same is hereby approved for payment.

CIVIL SERVICE NOTICES

Applications and full information covering the following examinations may now be obtained at the office of the civil service commission, 414 City Hall. Applications should be obtained as soon as possible, and must be filed by applicant in person at that office not later than 12 o'clock noon of the seventh day preceding the date of the examination.

Unless otherwise specified all examinations will be held at the examination room, second floor old Court House (Public Square).

FIREMEN,

OF FIRE, DEDIVISION PARTMENT OF PUBLIC SAFETY Civil service examination will be held in accordance with the rules and the law of the civil service commission, for positions of firemen in the division of fire, department of public safety, at a place to be later designated.

(This examination postponed indefintely). Each applicant will be required to undergo a physical examination, to be conducted by the medical officer of the division of fire, at the Orange ave. municipal bath house, 1611 Orange ave., at a time to be later announced by mail to each applicant.

Applicants rejected in the physical examination, will be disqualified.

Applicants must be not less than 5 feet 7 inches in height, must weigh not less than 140 pounds, must be not less than 19 nor more than 28 years of age, and must have resided in the city of Cleveland for a period of at least one year, next prior to the date of the examination.

LIGHT AND HEAT Sealed proposals will be received at the office of the commissioner of purchases and supplies, city hall, Cleveland, Ohio, until 12:00 o'clock noon, central standard time, July 25, 1918, for transformers and will be opened and read in room No. 305 city hall, immediately thereafter.

Each bid must be made in accordance with the specifications which may be obtained by applying to the office of the division of light and heat.

No proposals will be entertained unless made on the blanks furnished by the division of light and heat and delivered to the office of the commissioner of purchases and supplies, previous to 12:00 o'clock noon, central standard time, on the day above specified.

The city reserves the right to reject any or all bids.

REPAIRING PERCOLATOR SHELL AT THE CLEVELAND GARBAGE DIS

POSAL PLANT, WHLOW, O. Sealed proposals will be received at the office of the commissioner of purchases and supplies, room 219 city hall, until 12 o'clock noon (eastern standard time) July 25, 1918, for repairing percolator shell at the Clevelend garbage disposal plant, Willow, Ohio, and will be opened immediately thereafter in room 305 city hall.

Specification and bidding blank may be obtained at the office of the director of public service, room 314 city hall.

No proposal will be entertained unless made on the blank furnished by the director of public service and delivered at the office of the commissioner of purchases and supplies previous to 12 o'clock on the day specified.

LUBRICATING OILS AND GREASE Sealed bids will be received at the office of the commissioner of purchases and supplies, city hall, Cleveland, Ohio, until 12:00 o'clock, central standard time. August 2nd. 1918, for lubricating oils and grease for the division of water, and will be opened and read in room 305 city hall immediately thereafter.

Each bid must be made in accordance with the specifications which may be obtained by applying to the commissioner of water.

No proposal will be entertained unless made on the blanks furnished by the commissioner of water, and delivered to the office of the commissioner of purchases and supplies, previous to 12:00 o'clock noon. central standard time, on the day above specified.
