AN ACT to provide for the payment to the state by certain public utilities of the expense incurred by the Michigan Public Utilities Commission in auditing the books and records and appraising the plants, properties and facilities of said public utilities; and to appropriate said moneys towards the maintenance of said commission.

The People of the State of Michigan enact:

SECTION 1. Whenever the Michigan Public Utilities Comwho to make. mission finds it to be necessary to audit the books and records, or to appraise the plants, properties or facilities of any telephone, gas, electric light, and power, electric railway, water, heat or any other public utility under the jurisdiction of said commission for rate making, capitalization, or any other purpose, it shall have the right to make such audit and appraisal through its accounting, engineering and other forces, and shall keep an accurate, detailed account of all moneys expended and expenses incurred by said commission in and about such audit and appraisal.

SEC. 2. From time to time during the progress of the audit and appraisal, or at the conclusion of the same, said commission shall render to the utility in question, statements showing the amounts of money expended in such work, which expense shall be paid by such utility into the state treasury at such times and in such manner as the commission may by order require.

SEC. 3. All moneys paid into the state treasury by any public utility under the provisions of this act are hereby appropriated toward the payment of the expenses of the Michigan Public Utilities Commission.

This act is ordered to take immediate effect.

AN ACT to amend section one of act number one hundred ten of the Public Acts of nineteen hundred five, entitled "An act to authorize townships, cities and villages to appropriate money to defray the expenses of the proper observance of Memorial or Decoration day," being compilers' section three thousand two hundred ninety-six of the Compiled Laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section one of act number one hundred ten Section amended. of the Public Acts of nineteen hundred five, entitled "An act to authorize townships, cities and villages to appropriate money to defray the expenses of the proper observance of Memorial or Decoration day," being compilers' section three thousand two hundred ninety-six of the Compiled Laws of nineteen hundred fifteen, is hereby amended to read as follows:

SEC. 1. It shall be lawful for the township board of any Appropriation township, the board of trustees of any village, or the common day. council of any city in this state, to appropriate money for the purpose of defraying the expenses of the proper observ ance of Memorial or Decoration day: Provided, That the Proviso, limit. amount expended in any one year under the provisions of this act shall be limited as follows: In any township, city or village having a population of less than five thousand inhabitants, a sum not exceeding fifty dollars; in any village containing not less than five thousand inhabitants, a sum not exceeding one hundred dollars; in any village or city containing not less than ten thousand inhabitants, a sum not exceeding one hundred twenty-five dollars, and in any village. or city containing not less than twenty thousand inhabitants, a sum not exceeding one hundred fifty dollars, and in any city. containing not less than fifty thousand inhabitants, a sum not exceeding five hundred dollars. The sums hereby authorized to be appropriated shall be assessed, levied and collected in the same manner as other expenses of such township, village or city are assessed, levied and collected.

AN ACT to amend section five of act number three hundred seventy-two of the Public Acts of nineteen hundred nineteen, entitled "An act to provide a primary election system for the nomination of township officers," approved May thirteen, nineteen hundred nineteen.

The People of the State of Michigan enact:

SECTION 1. Section five of act number three hundred seventy-two of the Public Acts of nineteen hundred nineteen, entitled "An act to provide a primary election system for the nomination of township officers," approved May thirteen, nineteen hundred nineteen, is hereby amended to read as follows:

SEC. 5. Any township adopting the provisions of this act may at any time thereafter return to the system of nominating candidates for office as provided under the general election laws of the state by following the same procedure as Proviso, petl provided in this act for adopting the provisions thereof: Provided, That such action to return to the system of nominating candidates under the general election law shall be made only upon a petition signed by twenty-five per centum of the qualified electors of such township. Soldiers' memorial, erection of.

Nature of.

AN ACT to authorize and empower townships to own and acquire land by gift or purchase for the erection of memorials to soldiers and sailors; to authorize the erection of such memorials; to provide for the assessment, levy and collection of taxes therefor, for the custody, control and management of such memorials and providing for a referendum by the electors thereof.

The People of the State of Michigan enact:

SECTION 1. It shall be lawful for, and the several townships in the state of Michigan are hereby authorized and empowered to own and acquire by gift or purchase, land for the purpose of erecting thereon a suitable memorial to soldiers and sailors of any one or more of the wars in which the United States of America has been a participant, and to erect and own such memorial or receive the same, or money or property for the same, as a gift. Said memorial may be of

such a nature as to be used, maintained and enjoyed in whole or in part as a museum, library, auditorium or for any other public use or purpose, and such land may also be used, enjoyed and improved, in whole or in part, as a park, or the memorial may take such shape or form or be of such a nature as the township board shall adopt.

SEC. 2. For the purpose of providing funds to carry out May levy tax. the provisions of this act, the township board of such township shall at its annual meeting, levy a sufficient tax, in addition to other taxes now authorized by law, upon the real and personal property subject to taxation in such township, and such taxes shall be collected as other taxes are collected, and when collected shall be applied to the payment of any indebtedness incurred by any township coming under the provisions of this act, and to no other purpose: Provided, Proviso. That the taxes assessed, levied and collected shall not cause the limit of taxes established by law to be exceeded.

SEC. 3. The custody, management and control of such Custody of. memorial and all property belonging thereto or intended to be used in connection therewith, shall be vested in the township board of such township.

SEC. 4. This act shall not become operative until a ma- Referendum. jority of the electors voting at any regular or special election duly called shall vote in favor of it and shall so express themselves by ballot, upon the operation or non-operation of this act within their township, when properly submitted to such electors in accordance with the following procedure: Upon the filing with the township clerk, of a petition signed Petition. by not less than one hundred duly and legally qualified electors of such township praying therein for the submission of this question to the electors of their township, the township board shall thereupon meet and order the submission of the question to the electors of the township at the next regular election, which supplies ample time for proper notices and printing of ballots, or at a special election to be called for that purpose in the discretion of the township board; notices of such submission, the posting thereof, publication thereof, and contents thereof to be governed by the general laws pertaining to regular township elections. Ballots shall be furnished by the township board of the township in which submission of this question shall be requested by the requisite number of qualified petitioners of such township, and when voted shall be deposited in a ballot box provided for that purpose. The result of said vote shall be certified to the county clerk and by him to the board of supervisors of the county of which such township is a part, and such county clerk shall also certify the result of such vote to the Secretary of State; the result of such election shall also be publicly announced at the polls after the counting of the ballots, and from that time this act will be effective in accordance with the result of such vote. AN ACT to amend section twenty-two of chapter four of act number one hundred sixty-four of the Public Acts of eighteen hundred eighty-one, entitled "An act to revise and consolidate the laws relating to public instruction and primary schools, and to repeal all statutes and acts contravening the provisions of this act," being section five thousand seven hundred eight of the Compiled Laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section twenty-two of chapter four of act number one hundred sixty-four of the Public Acts of eighteen hundred eighty-one, entitled "An act to revise and consolidate the laws relating to public instruction and primary schools, and to repeal all statutes and acts contravening the provisions of this act," being section five thousand seven hundred eight of the Compiled Laws of nineteen hundred fifteen, is hereby amended to read as follows:

SEC. 22. The treasurer of a fractional school district of a township to the clerk of which the returns of such fractional school district shall be made, shall apply to the treasurer of any other township in which any part of such fractional school district may be situated, for any money to which such district may be entitled; and the treasurer paying over the same shall take a receipt therefor in duplicate, one copy of which he shall file in his office, and the other copy he shall send by mail, or deliver personally, to the clerk of the town
