shortest direct route, is more than three miles, except as to such part of said local boundary, which extends to the state boundary line or the population is more than two hundred fifty thousand, the fees for the above mentioned services to which constables shall be entitled to fees in civil suits, shall be as follows:

For serving a warrant, two dollars; for serving a summons, one dollar: Provided, however, That no mileage fees shall be Proviso. allowed;

For a copy of every summons delivered on request, or left at the dwelling house of the defendant in his absence, one dollar: Provided, however, That no mileage fees shall be Proviso. allowed;

For serving an attachment or writ of replevin, five dollars; and for copy thereof, and of the inventory of the property seized, one dollar: Provided, however, That no mileage fees Proviso. shall be allowed;

For serving a subpoena, one dollar for service upon each witness summoned by him: Provided, however, That no Proviso. mileage fees shall be allowed;

For serving an execution on the body or goods and chattels

of the defendant, one dollar, which fee of one dollar shall be paid in to the clerk of the court to be paid to the constable when the constable makes his return upon said writ: Pro- Proviso. vided, however, That no mileage fees shall be allowed;

For committing a defendant to prison on execution, two dollars: Provided, however, That no mileage fees shall be Proviso. allowed;

Summoning a jury, one dollar; attending upon a jury, fifty cents; for collecting and paying of money on executions, four per cent of the amount of the judgment; advertising property for sale, fifty cents for each copy of such advertisement; selling property, fifty cents; for attending the circuit court at the request of the sheriff, not less than one dollar and fifty cents for each day, to be paid out of the county treasury;

For making levy on execution, two dollars constable fee: Provided, however, That no mileage fees shall be allowed. Any Proviso. constable who shall wilfully collect more fees. for the service rendered than herein provided, shall upon conviction thereof be guilty of a misdemeanor and be punished by a fine not exceeding one hundred dollars or by imprisonment in the county jail or Detroit house of correction not exceeding ninety days, or by both such fine and imprisonment in the discretion of the court.

This act is ordered to take immediate effect.

AN ACT to authorize cemetery corporations to sell or convey property rights, franchises and liabilities to a municipal corporation.

The People of the State of Michigan enact:

SECTION 1. Any corporation organized under the law for the purpose of establishing or maintaining a cemetery or burying ground is hereby authorized to sell, assign, transfer or convey to any municipal corporation all or any part of its assets, rights, franchises and liabilities upon such terms as may be mutually agreed upon, whenever a majority of the owners of the stock or scrip issued by said cemetery corporation shall, at a special meeting called for that purpose, decide to do so.

SEC. 2. The board of directors or trustees of said cemetery corporation may, at a regular meeting thereof, pass a resolution containing the substance of the contract of conveyance proposed to be entered into between said corporation and any municipal corporation, and calling a special meeting of the stockholders or scrip holders for the purpose of authorizing such transfer.

SEC. 3. Notice of such meeting shall be given either by personal service upon said stockholders or by registered mail directed to the last known address of such stockholders and by publication of a notice for three consecutive weeks previous to the time of holding such meeting in a newspaper published and circulated in the county wherein said corporation has its principal office or place of business; such notice shall state the time and place of such meeting and the purpose thereof, and the substance of the contract of conveyance proposed to be entered into. Proof of such personal service, service by mail and publication shall be filed with the secretary of said corporation at or before such meeting.

SEC. 4. None of the legal rights and privileges, statutory not affected. or otherwise, of stockholders, scrip holders and lot holders of said corporation, shall be affected by the contract or conveyance by which said cemetery property is transferred to a municipal corporation, but said municipal corporation shall assume and perform all liabilities, charges and duties, statutory or otherwise, imposed upon or assumed by said corporation and fully perform all existing contracts or agreements of said cemetery corporation and shall carry out and perform all provisions as to maintenance whether imposed upon said corporation by statute or assumed by its by-laws and any fund for maintenance as provided by statute or by the by-laws of said corporation shall be by it turned over to said municipal corporation and shall be by said municipal corporation preserved, applied and used as shall have been by statute or by said by-laws provided.

AN ACT to make appropriations for the purpose of enabling the state of Michigan to accept the benefits of an act of congress, entitled "An act for the promotion of the welfare and hygiene of maternity and infancy, and for other purposes", as amended, and for carrying out the purposes of act number one hundred of the public acts of nineteen hundred twenty-five.

SECTION 1. To enable the state to accept and receive the Appropriabenefits of the provisions of an act of the sixty-seventh congress of the United States, approved November twenty-three, nineteen hundred twenty-one, known and designated as public act number ninety-seven, entitled "An act for the promotion of the welfare and hygiene of maternity and infancy and for other purposes", as amended, and also for carrying out the purposes contemplated by act number one hundred of the public acts of nineteen hundred twenty-five, there is hereby appropriated out of the general fund for the fiscal year ending June thirty, nineteen hundred twenty-eight, the sum of thirty thousand dollars, and for the fiscal year ending June thirty, nineteen hundred twenty-nine, the sum of thirty thou sand dollars. The auditor general shall incorporate in the Tax state tax for the years nineteen hundred twenty-seven and nineteen hundred twenty-eight, sufficient amounts to reimburse the general fund for the appropriations hereby made. This act is ordered to take immediate effect. Approved March 25, 1927.
