AN ACT to amend section two of act number two hundred seventy-eight of the public acts of nineteen hundred nine, entitled, as amended, “An act to provide for the incorporation of villages and for revising and amending their charters", being section two thousand eight hundred forty-four of the compiled laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. SEC. 2. Villages may be incorporated or territory detached When may therefrom or added thereto, or consolidation made of two or rate, etc. more villages into one village by proceedings originating by petition therefor signed by qualified electors residing within the cities, villages or townships to be affected thereby, to a number not less than one per centum of the population of the territory affected thereby according to the last preceding United States census, which number shall in no case be less than one hundred, and not less than twenty-five of the signatures to such petition shall be obtained from each city, village or township to be affected by the proposed change: Provided, Proviso, however, That when all or any part of the district proposed to signatures. be incorporated, annexed or detached has been subdivided into one or more subdivisions, the plat or plats of which have been recorded in the register of deeds' office of the proper county, the petition therefor shall be signed by qualified electors residing within each such subdivision and by qualified electors residing within the unsubdivided portion, if any, of such district to a number in each case of not less than one per centum of the population of each such subdivision and of such unsubdivided portion of such district, such population to be determined as of the date on which the first signature to such petition shall be obtained. Unlawful to take with nets.

or open season, having a sufficient force of men on each boat properly to save, handle, impregnate and deliver such spawn at any port or fishing ground when it has been determined that fish are ripe for spawning, and when such determination has been made by the state director of conservation the fishing season automatically opens at such port or fishing ground. Any person, firm, copartnership, association or corporation engaged in commercial fishing failing to properly save, handle, impregnate, and deliver such spawn during any period when spawn are ripe shall be deemed guilty of a violation of this act.

SEC. 17. It shall be unlawful for any person to take or catch with any kind of a net in any of the waters mentioned in this act, bass of any kind, any brook trout, rainbow trout, American brown trout, Lock Leven trout, steelhead trout or any species of brook trout, crappies, muskellunge, sturgeon and sunfish, or to call or offer for sale or to have in possession at any time any of the said fish taken with nets. Any such fish found in any net shall at once be returned to the waters from which taken with as little harm as possible to said fish, by the person or persons lifting the net or nets.

SEC. 23. Every person, firm, copartnership, association or corporation taking fish for the market in any of the waters mentioned in this act shall keep an accurate account of the number of pounds of each kind of fish taken and the number of quarts of spawn taken and the number of pounds of caviar taken by them, together with the disposition of such spawn and caviar, and shall on or before February first of each year report under oath to the state director of conservation the . total number of pounds of each of the kinds of fish caught during the year ending December thirty-first preceding the filing of the report, and the number of quarts of spawn taken and its disposition and the number of pounds of caviar taken. Any person, firm, copartnership, association or corporation failing to make the report as above shall in the discretion of the director of conservation be denied a license until such report is filed, in addition to the penalty prescribed in section twenty-four.
