CHAP. 34.

An Act respecting the Supreme Court of Ontario and the Judges thereof.

[Assented to 29th June, 1897.]

IIEREAS by Acts of the Legislature of the province of Preamble. Ontario it is provided to the effect hereinafter mentioned with respect to appeals to the Supreme Court of Canada, and it is desirable to confirm hereby the provisions of the said Acts: Therefore Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. No appeal shall lie to the Supreme Court of Canada from any judgment of the Court of Appeal for Ontario, except in the following cases :

(a.) Where the title to real estate or some interest therein in question;

(b.) Where the validity of a patent is affected; (c.) Where the matter in controversy in the appeal exceeds the sum or value of one thousand dollars, exclusive of costs;

(d.) Where the matter in question relates to the taking of an annual or other rent, customary or other duty or fee, or a like demand of a general or public nature affecting future rights;

(e.) In other cases where the special leave of the Court of Appeal for Ontario or of the Supreme Court of Canada to appeal to such last mentioned court is granted;

f) Whenever the right to appeal is dependent upon the amount in dispute, such amount shall be understood to be that demanded, not that recovered, if they are different.

The judges of the Supreme Court of Judicature for Judges of Ontario shall reside at the city of Toronto or within five miles Court of thereof, but leave to reside elsewhere in the province for any Ontario to respecified time may be granted from time to time by order of Toronto. the Governor in Council.
