Fourth. In the case of any shortage in which a court proceeding is contemplated by the institution against the person, firm or corporation furnishing the supplies, that this office be immediately notified.

Fifth. No remuneration from this department will be paid to the special deputy or deputies appointed for the aforesaid purpose.

Sixth. When a case in law is disposed of, send a report of it at once to this office giving in detail your connection with the case.

Seventh. In all cases where your signature is required in which you act in the capacity of special deputy add after your name: "Special Deputy of State Superintendent of Weights and Measures, designated under Chapter 187, Laws of 1910."

At a number of institutions a form of bound record book is used in which entries are made by means of pen and ink or by means of an indelible pencil. It will not be necessary to keep a separate set of books to comply with the foregoing regulations provided the deputy uses two separate sheets of the size of the page of the book and before making an entry in the book places the two sheets with carbon paper over each under the page on which he is writing and then writes with an indelible pencil. The first or original record will then remain in the book and the first carbon can be set to the Fiscal Supervisor of State Charities and the second carbon to the Superintendent of Weights and Measures.

The Superintendent of Weights and Measures, immediately after the enactment of the amendment to the law, began an inspection of all weights and measures of all institutions, and on November 7, 1910, submitted a report in detail, which is attached hereto:

HON. D. MCCARTHY, Fiscal Supervisor of State Charities, Albany, N. Y.: DEAR SIR. In compliance with chapter 187 of the Laws of 1910 I transmit herewith copies of the reports of tests made of the weighing and measuring apparatus in each institution. Where the apparatus has not been sealed and is faulty I should recommend that such apparatus be replaced if its use is necessary, and in replacing of such apparatus that the apparatus purchased comply with the printed specifications issued by this office.
