DEPARTMENT OF THE ARMY, SEATTLE DISTRICT, CORPS OF ENGINEERS, Seattle, Wash., August 13, 1971. GENTLEMEN: Reference is made to our letters of 7 May, 2 June, and 12 July 1971 to your firm regarding the filing of applications for Department of the Army permits to discharge into navigable waters of the United States and their tributaries.

Section 13 of the River and Harbor Act approved 3 March 1899 establishes the requirement that Department of the Army approval must be obtained for all discharges of refuse into navigable waters of the United States or into

any tributary of these waters. This requirement has been further strengthened by the National Environmental Policy Act of 1969 and the Water Quality Improvement Act of 1970. The President, in a statement accompanying his Executive order 11574 of December 23, 1970, set a target date of July 1, 1971 for submission of applications for Department of the Army permits to discharge wastes into the navigable waters. The July 1, 1971 date for filing for permits for existing discharges is further emphasized in Corps of Engineers regulations which were published in the FEDERAL REGISTER on April 7, 1971.

Our previous letters to you forwarded Department of the Army forms and instructions for making applications for discharge permits. To date we have yet to receive from you an application for permit or letter advising that your operations are excluded from the requirement of the law. The July 1, 1971 filing date was a firm date and failure to apply by that date is an indication to us that, if, in fact, you are a discharger, you do not intend to comply with the refuse act. Discharge of refuse without a permit is a violation of the law. Failure to hear from you within 15 days of your receipt of this letter will again indicate to us that you intend to remain in violation of the law. If subsequent investigation reveals that your activity does, in fact, require a permit, appropriate legal action will be taken to prevent any further unauthorized discharge into the navigable waters of the United States or their tributaries.

This certified letter is being dispatched to assure us that our correspondence is being received and that you have had ample opportunity to respond. Your cooperation in this matter will be appreciated. Sincerely yours,

SECTION 10

1. Graham Fitch, June 3, 1970, Lake Washington-piling for a new home. Violator required to apply for permit, June 4, 1970. Permit issued, September 1, 1970.

2. E. T. Hinrichs and Associates, August 5, 1970, Lake Union-piling for apartment house. U.S. Court decision, December 23, 1970, that work was commenced prior to change in pierhead-bulkhead line requirements date May 27, 1970. Accordingly, court ruled that permit was not required.

3. Sandpoint Development Company, June 8, 1971, Hawaiian Enterprises, Lake Pend Oreille. Referred to U.S. Attorney and a Consent Decree, August 2, 1971, was thereafter secured. Violator applied for permit and permit was issued.

SECTION 13

1. Joseph Mentor, April 22, 1970, Dyes Inlet-convicted in U.S. District Court, October 8, 1971, by jury trial. Fill removed.

2. Hydraulic Supply Company, April 14, 1970, Duwamish River-referred to U.S. Attorney for prosecution. Since material was placed prior to present owner acquiring property, U.S. Attorney's office did not prosecute but did require owner to clean up area.

1. Congress has authorized the U. S. Army Corps of Engineers to conduct a study to determine the advisability of a new civil works project (or modifying an existing project).

2. The red circle on the next page places this study in perspective among the many steps involved in a civil works project.

3. The second page depicts the many steps involved in a study. Circled in red is the current status of this study.

4. In certain cases, because of prior public involvement, it may not be necessary to conduct all four public meetings depicted on the second sheet. Also, for relatively small projects where Federal fund involvement is relatively small, one or two public meetings may be adequate to gain a full expression of the needs and views of the public. Another factor is that for small projects (such as a small boat marina where the Federal involvement is primarily fifty percent of the cost of the breakwater), there are insufficient Federal study funds to pay for multiple public meetings.
