CONSTITUTION.

(As promulgated May 25, 1833, and amended up to June 26, 1893.)

En el nombre de Dios Todopoderoso, Creador y Supremo Legislador del Universo.

La Gran Convención de Chile llamada por la ley del primero de octubre de mil ochocientos treinta y uno á reformar ó adicionar la Constitución Política de la Nación, promulgada en ocho de agosto de milochocientos veintiocho,después de haber examinado este Código, y adoptado de sus instituciones las que ha creído convenientes para la prosperidad y buena administración del Estado, modificando y suprimiendo otras, y añadiendo las que ha juzgado asimismo oportunas para promover tan importante fin, decreta que quedando sin efecto todas las disposiciones allí contenidas, sólo la siguiente es la Constitución política de la República chilena.

CAPÍTULO I.

DE LA FORMA DE GOBIERNO. ARTÍCULO 1. El Gobierno de Chile es popular representativo. ART. 2. La República de Chile es una é indivisible.

ART. 3. La soberanía reside esencialmente en la Nación que delega su ejercicio en las autoridades que establece esta Constitución.

CAPÍTULO II.

DE LA RELIGIÓN.

ART. 4. La religión de la República de Chile es la Católica Apostólica Romana, con exclusión del ejercicio público de cualquiera

In the name of Almighty God, the Creator and Supreme Law of the Universe.

The Great Convention of Chile called upon by the law of October first, eighteen hundred and thirty-one, to amend the Political Constitution of the Nation, promulgated on the eighth of August, eighteen hundred and twentyeight, after having examined that code, adopted those of its provisions believed to be conducive to the prosperity and good government of the State, modified and suppressed other provisions, and added some new ones deemed especially suitable to promote the same important end, decrees that all previous constitutions are repealed and that the following shall be the political Constitution of the Republic of Chile:

CHAPTER I.

THE FORM OF GOVERNMENT. ARTICLE 1. The Government of Chile is popular and representative. ART. 2. The Republic of Chile is one and indivisible.

ART. 3. The sovereignty is vested essentially in the Nation, which delegates its exercise to the authorities established by this Constitution.

CHAPTER II.

RELIGION.

ART. 4. The religion of the Republic of Chile is the Roman Cathofic Apostolic, to the exclusion of the public exercise of any other."

CAPÍTULO III.

DE LOS CHILENOS.

ART. 5. Son chilenos:

1o. Los nacidos en el territorio de Chile.

2o. Los hijos de padre ó madre chilenos, nacidos en territorio extranjero, por el solo hecho de avecindarse en Chile. Los hijos de chilenos nacidos en territorio extranjero, hallándose el padre en actual servicio de la República, son chilenos aún para los efectos en que las leyes fundamentales, ó cualesquiera otras, requieran nacimiento en el territorio chileno.

3o. Los extranjeros que habiendo residido un año en la República declaren ante la municipalidad del territorio en que residen su deseo de avecindarse en Chile y soliciten carta de ciudadanía.

CHAPTER III.

CHILEANS.

ART. 5. The following are Chile

ans:

1. Those born within the territory of Chile.

2. The children of Chilean father or mother born in foreign territory, by the sole fact of becoming domiciled in Chile. The children of Chileans born in foreign territory, while the father is in the actual service of the Republic, are Chileans for all intents and purposes, even those for which the fundamental laws, or any others, require nativity in Chilean territory.

3. Foreigners who, having resided one year in the Republic, declare before the municipal authorities of the district in which they reside their desire to become domiciled in Chile, and ask for papers of naturalization.

4. Those who have obtained an especial grant of naturalization by an act of Congress.

ART. 6. The power to declare that persons who have not been born in Chile are entitled to naturalization under clause 3 of the preceding article, belongs to the municipality of the department of their residence. Upon the favorable declaration of the municipality the President of the Republic shall issue the proper naturalization papers.

ART. 7. No one shall be a Chilean citizen entitled to vote, who has not reached the age of twentyone years, can not read and write, and has not been duly inscribed in the electoral register of the department.

These registers shall be open to the public for the period fixed by law.

The time for the registration shall not be interrupted, nor shall it be suspended except during the period fixed in the electoral law.

ART. 8. Se suspende la calidad de ciudadano activo con derecho de sufragio:

1o. For ineptitud física ó moral que impida obrar libre y reflexivamente.

2o. Por la condición de sirviente doméstico.

3o. Por hallarse procesado como reo de delito que merezca pena aflictiva ó infamante.

ART. 9. Se pierde la ciudadanía:

1o. Por condena á pena aflictiva 6 infamante.

2o. Por quiebra fraudulenta. 3o. Por naturalización en país extranjero.

4°. Por admitir empleos, funciones ó pensiones de un Gobierno extranjero sin especial permiso del Congreso.

Los que por una de las causas mencionadas en este artículo hubieren perdido la calidad de ciudadanos, podrán impetrar rehabilitación del Senado.

CAPÍTULO IV.

DERECHO PÚBLICO DE CHILE.

ART. 10. La Constitución asegura á todos los habitantes de la República:

1o. La igualdad ante la ley. En Chile no hay clase privilegiada.

2o. La admisión á todos los empleos y funciones públicas, sin otras condiciones que las que impongan las leyes.

3o. La igual repartición de los impuestos y contribuciones á proporción de los haberes, y la igual repartición de las demás cargas públicas. Una ley particular determinará el método de reclutas y reemplazos para las fuerzas de mar y tierra.

4°. La libertad de permanecer en cualquier punto de la República, trasladarse de uno á otro, ó salir de su territorio, guardán

ART. 8. Active citizenship with the right of suffrage shall be suspended for the following causes:

1. Physical or moral incapacity interfering with the free and reasonable use of the mental faculties. 2. The condition of domestic service.

3. Prosecution for a crime which merits corporal or infamous punishment.

ART. 9. Citizenship is lost for the following causes:

1. Condemnation to corporal or infamous punishment.

2. Fraudulent bankruptcy. 3. Naturalization in a foreign country.

4. Acceptance of employment, office, or salary from a foreign government, without special permission of Congress.

Those who from anyone of the causes enumerated in this article have suffered the loss of citizenship, may apply to the Senate for rehabilitation.

CHAPTER IV.

PUBLIC LAW OF CHILE.

ART. 10. The Constitution guarantees to all inhabitants of the Republic:

1. Equality before the law. In Chile no class privileges exist.

2. Admission to all public employments and offices without other conditions than those prescribed by law.

3. The equal distribution of imposts and taxes in proportion to property and the equal distribution of all other public charges. A special law shall determine the method of recruiting and enrolling substitutes for the land and naval forces.

4. The liberty of sojourn in any part of the Republic, of removal to any other part, and of departure from its territory, respecting, how

5o. La inviolabilidad de todas. las propiedades, sin distinción de las que pertenezcan á particulares ó comunidades, y sin que nadie pueda ser privado de la de su dominio, ni de una parte de ella por pequeña que sea, ó del derecho que á ella tuviere, sino en virtud de sentencia judicial; salvo el caso en que la utilidad del Estado, calificada por una ley, exija el uso ó enajenación de alguna; lo que tendrá lugar dándose previamente al dueño la indemnización que se ajustare con él, ó se avaluare á juicio de hombres buenos.

6o. El derecho de reunirse sin permiso previo y sin armas.

Las reuniones que se tengan en las plazas, calles y otros lugares de uso público, serán siempre regidas por las disposiciones de policía.

El derecho de asociarse sin permiso previo.

El derecho de presentar peticiones á la autoridad constituida sobre cualquier asunto de interés público o privado no tiene otra limitación que la de proceder en su ejercicio en términos respetuosos y convenientes.

La libertad de enseñanza.

7°. La libertad de publicar sus opiniones por la imprenta, sin censura previa, y el derecho de no poder ser condenado por el abuso de esta libertad, sino en virtud de un juicio en que se califique previamente el abuso por jurados, y se siga y sentencie la causa con arreglo á la ley.

5. The inviolability of property of all kinds, whether belonging to individuals or corporations. No one shall be deprived of his property or of any part thereof, however small, or of any right therein, except by virtue of a judicial decision, or when the interest of the State, declared by law, requires the use or condemnation thereof; but in this case proper indemnification to be determined either by agreement with the owner or by valuation made by a jury of competent men shall be previously made.

6. The right to assemble without previous permission and without arms.

Meetings held in squares, streets, and other public places shall always be subject to the police regulations.

The right to form associations without previous permission.

The right to present petitions to the properly constituted authorities on any subject of public or private interest has no other restriction than that of using respectful and proper language.

The liberty of teaching.

7. The liberty of publishing through the press, without previous censorship, their own opinions; and no one shall be condemned for abuse of this liberty except upon trial and conviction by a jury according to law.

CAPÍTULO v.

DEL CONGRESO NACIONAL.

ART. 11. El Poder Legislativo reside en el Congreso Nacional compuesto de dos Cámaras, una de Diputados y otra de Senadores.

ART. 12. Los Diputados y Senadores son inviolables por las opiniones que manifiesten y votos que emitan en el desempeño de sus

cargos.

ART. 13. Ningún Senador ó Diputado, desde el día de su elección, podrá ser acusado, perseguido ó arrestado, salvo en el caso de delito in fraganti, si la Cámara á que pertenece no autoriza previamente la acusación declarando haber lugar á formación de causa.

ART. 14. Ningún Diputado ó Senador será acusado desde el día de su elección, sino ante su respectiva Cámara, ó ante la Comisión Conservadora, si aquélla estuviere en receso. Si se declara haber lugar á formación de causa, queda el acusado suspendido de sus funciones legislativas y sujeto al juez competente.

ART. 15. En caso de ser arrestado algún Diputado ó Senador por

delito in fraganti, será puesto inmediatamente á disposición de la Cámara respectiva ó de la Comisión Conservadora, con la información sumaria. La Cámara ó la Comisión procederá entonces conforme á lo dispuesto en la segunda parte del artículo precedente.

DE LA CÁMARA DE DIPUTADOS. ART. 16. La Cámara de Diputados se compone de miembros elegidos por los Departamentos en votación directa, y en la forma que determinare la ley de elecciones.

ART. 17. Se elegirá un Diputado por cada treinta mil habitan

CHAPTER V.

THE NATIONAL CONGRESS.

ART. 11. The legislative power is vested in the National Congress, composed of two chambers, one of deputies, the other of senators.

ART. 12. The deputies and senators are inviolable for the opinions expressed and the votes cast by them in the discharge of their duties.

ART. 13. From the day of his election no senator or deputy shall be accused, prosecuted, or arrested, except when taken in flagrante delicto, unless the chamber of which he is a member has previously authorized the prosecution.

ART. 14. From the day of his election no deputy or senator shall be accused except before the chamber of which he is a member, or before the permanent committee, if the chamber is not in session. If the prosecution is authorized, the accused shall be suspended from his legislative functions, and subjected to the proper tribunal.

ART. 15. Deputies or senators arrested in flagrante delicto, shall be placed immediately at the disposal of their respective chamber, or of the permanent committee. The record of the preliminary investigation shall be forwarded to either at the same time. chamber or the committee shall thereupon proceed according to the method stated in the second part of the preceding article.

THE CHAMBER OF DEPUTIES.

ART. 16. The Chamber of Deputies shall be composed of members elected from the departments by direct vote in the manner determined by the electoral laws.

ART. 17. One deputy shall be elected for each thirty thousand
