ras locales, decretar la creación de éstas y darles sus atribuciones por medio de una ley especial.

35°. Decretar la reforma de la Constitución del Estado, en la forma y manera que ella previene. 36°. Aprobar ó desaprobar las concesiones ó contratos que hagan el Poder Ejecutivo ó los Ayuntamientos, siempre que afecten rentas generales o comunales. Aprobar ó desaprobar los arbitrios municipales que tengan carácter de impuestos no establecidos por la ley.

37°. Decretar, en circumstancias excepcionales y apremiantes, la traslación del Ejecutivo á otro lugar.

38°. Determinar sobre todo lo relativo á la habilitación de los puertos y costas marítimas.

39°. Fijar anualmente el pie del ejército permanente en la República, y dictar las ordenanzas de la fuerza armada de mar y tierra.

40°. Expedir la ley electoral. 41°. Dictar las leyes de responsabilidad de todos los empleados, por mal desempeño en el ejercicio de sus funciones.

42°. Determinar la manera de conceder grados ó ascensos mili

tares.

43°. Dictar los reglamentos que deban observarse en las sesiones ó debates.

44°. Expedir todas las leyes que sean necesarias para la buena marcha y administración de la República.

45°. Interpelar á los Secretarios de Estado sobre todos los asuntos de interés público.

46°. Examinar, al fin de cada período constitucional, los actos administrativos del Poder Ejecutivo, y aprobarlos si fueren conformes á la Constitución y á las leyes, y en caso contrario, desaprobarlos, y si ha lugar, decretar la acusación de sus miembros individual ó colectivamente.

36. To approve or disapprove the concessions or contracts made or entered into by the Executive power or by the municipal corporations, when affecting general or municipal revenue. To approve or disapprove municipal taxes not established by law.

37. To decree under exceptional and urgent circumstances the moving of the Executive to another place.

38. To provide for the opening of ports of entry and the custody of the seacoast.

39. To fix every year the force of the standing army of the Republic, and promulgate ordinances for the armed forces on land and sea.

40. To enact the electoral law.

41. To enact laws fixing the responsibility of all public officials for malfeasance in the exercise of their functions.

42. To determine the manner of granting military ranks or promo

tions.

43. To make rules to be observed in the congressional debates.

44. To enact all laws necessary for the proper administration of the government of the Republic.

45. To make interpellations to the secretaries of state on all subjects of public interest.

46. To examine at the end of each constitutional period all the acts of the Executive power, and approve them if they are in accordance with the Constitution and the laws; and if not, disapprove them. It shall also decree whether the members of the Executive should or should not be impeached, either individually or collectively.

ART. 26. El Congreso podrá conocer y resolver en todo negocio que no sea de la competencia de otro Poder del Estado, ó contrario al texto constitucional.

ART. 26. Congress shall take cognizance and pass upon every matter of business not belonging to the jurisdiction of the other powers of the State, or excluded from its action by the text of the Constitution.

SECCIÓN II.

"De la formación de las leyes.

ART. 27. Tienen derecho de iniciativa en la formación de las leyes: 1o. El Congreso, á propuesta de uno ó más de sus miembros.

2o. El Poder Ejecutivo. 3o. La Suprema Corte de Justicia, en asuntos judiciales.

ART. 28. Todo proyecto de ley, ó decreto tomado en consideración por el Congreso, se someterá á tres discusiones distintas, con intervalo de un día por lo menos entre una y otra discusión.

Párrafo. En caso que el proyecto de ley ó decreto fuere declarado de urgencia, podrá ser discutido en tres sesiones consecutivas, aunque no haya entre una y otra el día de intervalo indicado.

ART. 29. Los proyectos de leyes y decretos que no hayan sido tomados en consideración por el Congreso no podrán volver á proponerse hasta la siguiente reunión ordinaria; sin embargo, alguno ó muchos de sus artículos podrán formar parte de otros proyectos.

ART. 30. Ningún proyecto de ley ó decreto aprobado por el Congreso tendrá fuerza de ley, mientras no sea promulgado por el Poder Ejecutivo. Este, si no le hiciere observaciones, lo mandará á publicar y ejecutar como ley; pero si hallare inconvenientes para su ejecución, lo devolverá con sus observaciones al Congreso, en el preciso término de ocho días á contar de la fecha en que se le remita. ART. 31. Cuando el Poder Ejecutivo tenga que hacer observaciones á las leyes y decretos declarados de

SECTION II.

Enactment of laws.

ART. 27. The initiative in the enactment of laws shall belong: 1. To Congress at the request of one or more of its members. 2. To the Executive power. 3. To the supreme court of justice in judicial matters.

ART. 28. Every bill introduced in Congress shall be submitted to three different discussions, with an interval of one day at least between one and another.

Paragraph. In case that a bill is declared urgent, it may be discussed in three consecutive meetings, without the interval of one day above stated being required.

ART. 29. Bills failing to be passed by Congress can not be reintroduced until the next ordinary session. Nevertheless, one or several articles of a rejected bill may be made part of new bills.

ART. 30. No bill or resolution passed by Congress shall become a law until it is promulgated by the Executive power. If not objected to by the latter, it shall be ordered to be published and obeyed as law; but if objected to it shall be returned to Congress together with the objections of the Executive, within eight days, to be counted from the date on which it was sent to the latter.

ART. 31. When the Executive power objects to acts of Congress declared to be urgent, the objec

ART. 32. Si el Congreso encontrare fundadas las observaciones del Poder Ejecutivo, reformará el proyecto, ó lo archivará dado el caso que aquéllas versaren sobre la totalidad de él; más si á juicio de las dos terceras partes de los miembros presentes no las hallare fundadas, enviará de nuevo al Poder Ejecutivo la ley ó decreto para su promulgación, sin que pueda por ningún motivo negarse á hacerlo en este caso.

ART. 33. No podrá hacerse ninguna ley contraria al espíritu ni á la letra de la Constitución. En caso de duda el texto de ésta debe siempre prevalecer.

ART. 34. La ley que reforme otra se redactará íntegramente y se derogará la anterior en todas sus partes; exceptuándose de esta disposición las que formen parte de un cuerpo de códigos.

ART. 35. Las leyes no estarán en observancia sino después de publicadas con la solemnidad que se establezca.

Párrafo. Tampoco tendrán fuerza de ley, mientras no sean promulgadas en el periódico oficial, las concesiones otorgadas por el Poder Ejecutivo y aprobadas por el Congreso.

ART. 36. Las leyes no tienen efecto retroactivo sino en el caso de que sean favorables al que esté sub judice, ó cumpliendo condena.

ART. 37. En todas las leyes se usará de esta fórmula: "El Congreso Nacional, en nombre de la República, decreta."

tions shall be sent within three days. If no objection is found, the approval of the act shall be made within the same period, without discussing its urgency.

ART. 32. Should Congress find that the objections of the Executive are good and valid, it shall either amend the bill, or send it to the archives, if the remarks refer to the whole of it. But if, in the judgment of two-thirds of the members present, the objections of the Executive are not well founded, the bill shall be again sent to it for its promulgation, and the Executive shall under no circumstances refuse to do so.

ART. 33. No law can be enacted against the spirit or the letter of the Constitution. In case of doubt the textual language of the latter shall always prevail.

ART. 34. Amendments to laws. shall be made in the shape of an entirely new law, which shall repeal in toto the amended statute, and take its place. Amended articles or clauses of a code are excepted from these rules.

ART. 35. No laws shall be in force until after published with the prescribed solemnity.

Paragraph. Nor shall the concessions granted by the Executive power and approved by Congress be in force until after they are published in the official newspaper.

ART. 36. Laws shall have no retroactive effect, except in case that they are favorable to the one who is on trial or serving a sentence.

ART. 37. The enacting clause of all laws shall be: "The National Congress in the name of the Republic decrees."

TÍTULO VII.

SECCIÓN 1.

Del Poder Ejecutivo.

ART. 38. El Poder Ejecutivo se ejerce por el Presidente de la República, en unión de los Secreta rios de Estado en los respectivos despachos, como sus órganos inmediatos.

ART. 39. El Presidente de la República es el jefe nato de la administración general, y no tiene más facultades que las que expresamente le confieren la Constitución y las leyes.

ART. 40. Para ser Presidente de la República se requiere:

1o. Ser dominicano de nacimiento ú origen y residir en la República.

2o.

Tener por lo menos treinta

años de edad. 3o. Estar en el goce de los derechos civiles y políticos.

ART. 41. La elección de Presidente se hará por el voto indirecto y en la forma que esta Constitución y la ley determinan.

ART. 42. El Presidente de la República se elige en la forma siguiente: Cada elector vota por el ciudadano de su preferencia. Los procesos verbales de elección se remiten cerrados y sellados al Presidente del Congreso. Cuando el Presidente reúna los pliegos de todos los Colegios Electorales, los abrirá en sesión pública y verificará los votos. Si alguno de los candidatos reuniere la mayoría absoluta de sufragios, será proclamado Presidente de la República. Siempre que falte la mayoría indicada, el Congreso separará los tres que reúnan más sufragios, y procederá á elegir uno de entre ellos. Si en este primer escrutinio ninguno obtuviere la mayoría abso

TITLE VII.

SECTION 1.

The Executive power.

ART. 38. The Executive power is vested in the President of the Republic in union with the secretaries of state of the respective departments as his immediate or

gans.

ART. 39. The President of the Republic is the head, ex officio, of the general administration of the Government, but has no other powers than those expressly vested in him by the Constitution and the laws.

ART. 40. To be President of the Republic the following qualifications are necessary:

1. To be a Dominican by birth or origin and a resident of the Republic.

2. To be over thirty years of

age.

3. To be in the full enjoyment of the civil and political rights.

ART. 41. The election of the President shall be made by indirect vote in the form established by the Constitution and the laws.

ART. 42. The President of the Republic shall be elected in the following manner. Each elector shall vote for the citizen whom he may prefer. The minutes of the election shall be sent in a sealed envelop to the President of the Congress. When the President of the Congress has in his possession all the minutes sent by the electoral colleges, he shall unseal the envelops in public session and count the votes. The candidate having an absolute majority of votes shall be proclaimed President of the Republic. If no absolute majority is obtained, Congress shall choose the names of the three candidates having the highest number of votes, and from among them shall

ART. 43. Si veinte días después del último señalado para la elección no se hubieren recibido todas las actas de los Colegios Electorales, podrá efectuarse el cómputo con las que se hallen en poder del Congreso, siempre que no bajen de las tres cuartas partes.

ART. 44. El Presidente de la República durará en sus funciones cuatro años, á contar del día que tome posesión de su cargo, y podrá ser reelecto.

ART. 45. Habrá un Vicepresidente, que deberá reunir las mismas cualidades que se requieren para ser Presidente, y será elegido en el mismo tiempo y con las mismas formalidades que aquél.

ART. 46. En caso de muerte, renuncia ó inhabilitación del Presidente, el Vicepresidente ejercerá la presidencia de la República hasta cumplirse el período; y en caso de acusación ú otro impedimento temporal, la ejercerá solamente mientras dure la causa que lo motive.

ART. 47. Á falta del Presidente y Vicepresidente de la República, el Consejo de Secretarios de Estado ejercerá el Poder Ejecutivo, debiendo convocar los Colegios Electorales en el término de cuarenta y ocho horas para el nombramiento de dichos funcionarios, y al Congreso para que cumplimente lo que

All these operations shall be performed in one session, which shall be permanent and during which no deputy shall be permitted to absent himself or abstain from voting.

ART. 43. If twenty days after the expiration of the time prescribed for the election, the minutes of all the electoral colleges have not been received, the counting of the votes shall be made with only those which are in the possession of Congress, provided that they are not less in number than threefourths of the total.

ART. 44. The President of the Republic shall serve for four years, to be counted from the day of his inauguration; and he may be reelected.

ART. 45. There shall be a Vicepresident who shall have the same qualifications as are required to be President, and he shall be elected at the same time and with the same formalities as the President.

ART. 46. In case of death, resignation, or inability of the President, the Vice-president shall act only during the time of the suspension; and in impeachment proceedings or other temporary impediment, the Vice-president shall act only during the trial or while said impediment exists.

ART. 47. If there is no President or Vice-president of the Republic, the Council of secretaries of state shall act as Executive. It shall within forty-eight hours call the electoral colleges to convene for the appointment of said functionaries, and Congress to meet also for the purposes of sec
