Definition of vessel. The word "vessel" includes every description of watercraft or other artificial contrivance used or capable of being used as a means of transportation on water. 2. Vessels of the United States. R. S., 3. Vessels registered pursuant to law, and no others, except R. S., 4131. such as shall be duly qualified, according to law, for carrying on the coasting trade and fisheries, or one of them, shall be deemed vessels of the United States, and entitled to the benefits and privileges appertaining to such vessels; but they shall not enjoy the same longer than they shall continue to be wholly owned by citizens and to be commanded by a citizen of the United States. [See also Qualifications of officers, paragraph 53.] 3. Registered vessels. Vessels built within the United States, and belonging R. S., 4132. wholly to citizens thereof, and vessels which may be captured in war by citizens of the United States, and lawfully condemned as prize, or which may be adjudged to be forfeited for a breach of the laws of the United States, being wholly owned by citizens, and no others, may be registered as directed in this title [R. S., 4136. tion may issue a register or enrollment for any vessel built in a foreign country, whenever such vessel shall be wrecked in the United States, and shall be purchased and repaired by a citizen of the United States, if it shall be proved to the satisfaction of the [Secretary] Commissioner that the July 5, 1834. repairs put upon such vessel are equal to three fourths of Sec. 2. the cost of the vessel when so repaired. No vessel shall be entitled to be registered as a vessel of the United States, or, if registered, to the benefits of reg. istry, if owned in whole or in part by any person natural R. S., 4135. R. "A vessel registered pursuant to law, which by sale has States, or an agent for anu a parti No vessel which has been recorded or registered as an No vessel which is registered, pursuant to any law of the United States, and which is seized or captured and condemned, under the authority of any foreign power, or which by sale becomes the property of a foreigner, shall be entitled to or capable of receiving a new register, notwithstanding such vessel should afterward become American property; but all such vessels shall be taken and considered, to all intents and purposes, as foreign vessels. Nothing in this section shall extend to or be construed to affect the person owning any vessel at the time of the seizure or capture of the same, or his executor or administrator, or shall prevent such owner or his executor or administrator, in case he regain a property in such vessel, so condemned, by purchase or otherwise, from claiming and receiving a new register for the same, as he otherwise might have done. 5. Whaling vessels. All vessels which may clear with registers for the purpose of engaging in the whale fishery shall be deemed to have lawful and sufficient papers for such voyages, securing the privileges and rights of registered vessels, and the privileges and exemptions of vessels enrolled and licensed for the fisheries.
