Agreement with a mill-wright. Be it remembered, That it is this day agreed by and between Benjamin Custis and David Finch, both of Clay county and state of Indiana, that the said Benjamin Custis from the day of the date hereof, for and during the term of three years, if both parties shall so long live, shall and will, at the present dwelling house of the said David Finch, in the county aforesaid, or at such other places as the said David shall, from time to time, direct, work as a journeyman, in the business of a mill-wright, carpenter, turner, and in all such other arts, mysteries and work, as the said Benjamin is or shall be capable of performing during the term aforesaid, according to the best of his ability and judgment; and that he the said Benjamin, during the continuance of the said term, shall and will yearly work and perform the trade and business aforesaid, for him the said David, at suitable times of the year, to wit: from the first day of March to the first day of November yearly and every year during the term aforesaid, and from the hour of six in the morning to six in the evening, each and every day, except Sundays, the fourth of July, and such other days as he may be lawfully required to muster, or work on roads, and the usual time each day for necessary refreshment. In consideration whereof the said David Finch covenants to pay to the said Benjamin Custis fifty dollars per month, for all the time the said Benjamin shall continue to labour for him the said David in manner aforesaid, which said wages he the said David covenants and agrees to pay to the said Benjamin on the last day of each month; and for and during the time in which the said Benjamin is so as aforesaid in the employ of the said David, in the business aforesaid, the said David further agrees and covenants to find and provide for him the said Benjamin, sufficient meat, drink, washing, and lodging. And for the performance of all the aforesaid covenants and agreements, the said parties do hereby bind themselves, each to the other, in the penal sum of five hundred dollars, lawful money of the United States, firmly by these presents. BENJAMIN CUSTIS, [SEAL.] [SEAL.] Agreement with a mill-wright, to rebuild mills at certain weekly wages. This agreement, this day made and concluded between George How, of the county of Union and state of Indi. ana, of the one part, and Edwin Baxter and Enos Ferrel, of Fayette county and state aforesaid, of the other part, witnesseth, that the said George How, for the considerations hereinafter mentioned, covenants, promises, and agrees to and with the said Edwin Baxter and Enos Ferrel, and each of them, that he the said George How will, on or before the first day of April next, go to the mills of the said Edwin and Enos in Union county aforesaid, and there will proceed, in a good and workmanlike manner, according to the best of his art and skill, by and with the direction of the said Edwin and Enos, or one of them, to rebuild the said mills, with such materials, and with the aid of such workmen, to be employed by the said Edwin and Enos, and to be under the direction of the said George, as they the said Edwin and Enos shall find and provide for that purpose. In consideration whereof the said Edwin and Enos do hereby covenant, promise, and agree to and with the said George, that they will pay or cause to be paid to him the said George, for all such time as he shall be in their employ as aforesaid, in rebuilding the said mills, weekly and every week, the sum of ten dollars per week, to be paid to him the said George, by them the said Edwin and Enos, or by one of them, at the aforesaid mills, and the said Edwin and Enos further promise and agree to pay to the said George, the additional sum of forty dollars for his expenses in going to and returning from the said mills. And the said George further covenants and agrees to and with the said Edwin and Enos, that he will not absent himself from the said work, so as to have the hands under his direction, left idle, or the work retarded, on pain of forfeiting out of 1 the said wages, hereby stipulated to be paid to him by the said Edwin and Enos, the sum of three dollars per day, for every day he shall so absent himself without the assent and approbation of the said Edwin and Enos or one of them. In witness whereof the said parties have hereunto set their hands and seals this 10th day of March, 1832. GEORGE HOW [SEAL.] EDWIN BAXTER [SEAL.] ENOS FERREL [SEAL.] Agreement with bricklayers and plasterers. It is this day agreed, between William Belding, of Hamilton county and state of Indiana, of the one part, and Thomas Crume and Samuel Davidson, of the county and state aforesaid, of the other part, that the said Thomas Crume and Samuel Davidson, for the consideration hereinafter mentioned shall and will, in a good and sufficient workmanlike manner, at their own charges, with the materials to be provided for the purpose by the said Wil liam Belding, do and perform all the bricklayer's and plasterer's work, in and about the erecting and building of a good and substantial new house or tenement, on the ground of the said William in the county of Hamilton aforesaid, and the said Thomas Crume and Samuel Davidson do hereby covenant, and promise to and with the said William Belding, that they will build the same in such manner, and the walls of such thickness, and the sto ries of such height, and will make therein such and so many lights, chimneys, and conveniences, and in such parts of the said building as the said William Belding shall order and direct, and that they will take the utmost care in working up the materials which the said William shall furnish, to the best advantage and with the least loss or waste, and will completely finish all the said bricklaying and plastering of the said intended house, on or before the first day of September next ensuing the date hereof. In consideration whereof, the said William covenants, promises, and agrees to and with the said Thomas and Samuel, that he the said William will well and truly pay or cause to be paid to the said Thomas and Samuel for all such work which shall be by them done and perform ed, in and about the said building, ornamental work excepted, t and after the rate of per yard for every yard which the said work shall measure, accounting three feet square for every yard and for all ornamental work to be done and performed as aforesaid, but no work is to be measured or paid for that is not covered with plaster, nor is any extra charge to be made or allowed for corners, arches, jambs, joints, fire-places, or any other kind of work whatever, usually or at any time rated as extra, but the whole is to be measured as plain: And the said William engages and promises to pay for all the said work in the following manner, to wit: one half the amount as soon as the said work is finished and measured, and the remainder within six months afterward. Articles of agreement made and entered into, the second day of July in the year of our Lord eighteen hundred and thirty-two, between Francis Dudley and George Moore, both of Madison county and state of Indiana, aś follows, to wit: The said Francis Dudley and George Moore have agreed to become copartners together in the art or trade of painting, and all things thereunto belonging, and also in buying, selling, vending, and retailing all sorts of wares, goods, and commodities, belonging to the said trade of painting; which said copartnership it is agreed shall continue from the first day of June next ensuing the date hereof, for and during, and to the full end and term of ten years from the said first day of June, then next ensuing, and fully to be complete and ended. And to that end and purpose, he the said Francis Dudley has, on the day of the date of these presents, delivered in as stock, the sum of seven hundred and fifty dollars, and the said George Moore, the sum of five hundred dollars, to be used, laid out, and employed, in common betweenthem, for the management of the said trade of painting, to their mutual advantage and benefit. And it is hereby agreed by and between the said parties, and the said copartners, each for himself respectively and for his own particular part, covenants, promises, and agrees, each with the other, that they the said copartners shall not, nor will not, at any time hereafter, use, exercise, or follow the trade of painting aforesaid, or any other trade whatsoever, during the said term, to their separate benefit and advantage; but shall and will, from time to time, and at all times during the said term, if they shall both so long live, do their and each of their utmost and best endea vours, in and by all possible means, to the utmost of their power and skill, to promote their joint interest, profit and advantage; and that they and each of them will truly employ, buy, sell, and trade with the stock as aforesaid, and the increase thereof in the business aforesaid, without any sinister intention or fraudulent design whatsoever. And also that they the said copartners shall and will from time to time, and at all times hereafter, during the said term, pay, bear, and discharge, equally between them, the rent of the shop which they shall rent or hire, for the joint exercise and management of the trade and business aforesaid. And that all such gain, profit and increase as shall come, grow, or arise, for or by reason of the said trade or joint business as aforesaid, shall, from time to time, during the said term, be equally divided between them, share and share alike. And also that all such losses as shall happen in the said joint trade, by bad debts, or otherwise, without fraud or covin, shall be equally borne and paid. And it is further agreed by and between the said copartners, that there shall be had and kept, from time to time, and at all times during the said term and joint business and copartnership together as aforesaid, perfect, just and true books of accounts, wherein each of the said copartners shall duly enter and set down, as well all money by him received, paid, expended, and laid out, in and about the management of the said trade, as also all wares, goods, commodities and merchandises by them or either of them, bought or sold by reason or means, or on account of the said copartnership, and all other matters. and things whatsoever, to the said joint trade and the management thereof in anywise belonging or appertaining, which said books shall be used in common between |
