The state of Indiana, to Barbara Roe, widow and relict of Richard Roe, late of Madison county, deceased greeting.

At the instance of John Dickson, of said county, you are hereby cited to be and appear before the honorable John Doe, judge of our probate court in and for the said county, at the court house in Andersontown on the twentieth day of july next, then and there to take administration of the estate of your deceased husband, who lately died intestate, as it is said, or renounce your right so to do. Herein fail not.

Citation, to executors to prove a will.

State of Indiana, Madison county, to-wit:

The state of Indiana, to John Roe and William Roe of the county of Madison, greeting.

Whereas information has been given to our honorable probate court, in and for the said county, that Richard Roe of said county lately died, having previously made his last will and testament in writing, and appointed you, the said John and William, executors thereof; therefore, you, and each of you, are hereby cited to be and appear before the honorable John Doe, judge of our probate court, in and for the said county, at the court house in Andersontown, on the twentieth day of July next, then and there to make probate of said will and take letters testamentary thereon, according to law, or renounce your right to the executorship, that an administrator, with the will of the said Richard Roe annexed, may be ap

pointed according to law. Herein fail not. Witness, Ezra Stiles, clerk, and the seal of the said court hereto affixed, at Andersontown in the county aforesaid, the 10th day of June A. D. 1832, EZRA STILES, Clerk.

Renunciation, by a widow, of her right to administer.

1 Barbara Roe, of the county of Madison and state of Indiana, widow of Richard Roe, late of said county,-deceased, have renounced, and do by these presents renounce, release and forever quit claim, all my right and title to the administration of the estate of the said deceased; and I desire that the same may be committed to my friends, John Roe and William Roe, or to such other person or persons as the honorable probate court may think proper to appoint.

Oath of administrators, in the usual form.

You and each of you do solemnly swear, that you will well and truly administer all and singular the goods and chattels, rights, credits, and effects of Richard Roe deceased, and pay his debts as far as his assets will extend, and the law require; and that you will make a true inventory of all the said goods, chattels, credits, and personal estate, and render a just account thereof when thereunto required. So help you God; [or, as you shall answer to God.]

Oath of an executor in the usual form.

You solemnly swear, that this writing is the true and genuine last will and testament of Richard Roe deceased, so far as you know or believe; and that you will well and truly execute and perform the same, by paying his debts, and the legacies contained in said will, so far as his goods, chattels, credits, and effects will extend, and the law require; and that you will make a true inventory of all the goods, chattels, credits, and effects of the said tes

You solemnly swear, that you will truly and faithfully perform the duties and trusts committed to, and required of you, as executor of the last will and testament of Richard Roe, deceased. So help you God.

Administration Bond; usual form.

Know all men by these presents, that we John Roe, William Roe, John Den, and Richard Fen, all of Madison county, are held and firmly bound unto the state of Indiana, in the sum of four thousand dollars, lawful money of the United States, for the payment of which, to the said state of Indiana, well and truly to be made and done, we bind ourselves, and each of us, our heirs, executors, and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this 20th day of July, A. D. 1832.

The condition of the above obligation is such, that if the above bound John Roe and William Roe, adminis traters of all and singular the goods, chattels, rights, credits, moneys and effects of Richard Roe, deceased, do make or cause to be made, a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased, which have or shall come to their hands or possession, or into the hands or possession of any other person or persons for them, and the same do exhibit in the probate court of the said county of Madison, on or before the twen tieth day of June in the year of our Lord eighteen hundred and thirty-three; and all other goods, which at any time af ter shall come to their hands or possession, or to the hands

br possession of any other person or persons for them, do well and truly administer according to law; and further do make, or cause to be made, a true and just account of their said administration, on or before the twentieth day of June in the year of our Lord, eighteen hundred and twenty-four; and all the rest and residue of the said goods, chattels, and credits which shall be found remaining upon the account of the said administrators, the same being examined and allowed by the probate court, shall deliver and pay over to such person or persons as the said court, by their sentence or decree, shall appoint; and if it shall hereafter appear that any last will and testament was made by the said deceased, and the executor or executors therein named do exhibit the same in the said probate court, if the above named John Roe and William Roe do render and deliver the said letters of administration in the said probate court, then the above obligation is to be void and of none effect, otherwise to be and remain in full force and virtue in law.

The condition of the above obligation is such, that if the above bound John Roe and William Roe will truly and faithfully perform the duties and trusts committed to them, as executors of the last will and testament of Richard Roe deceased, according to law, then the above obligation is to be void and of none effect, otherwise to be and remain in full force and virtue in law.

I, Ezra Stiles, clerk of the probate court of the county of Madison, in the state of Indiana, do certify the annexed to be a true copy of the last will and testament of Richard Roe, late of the said county, deceased, and that John Roe and William Roe, executors therein named, have duly proved the same, according to law, and are duly authorized to take upon themselves the administration of the estate of the said testator, according to the said will.
