said president shall also be authorized to administer the oath of office to all the policemen by them appointed in said borough, as is required by law to be administered to the constables of this state.

An act to facilitate the collection of Taxes in Atlantic City,

CHAPTER CCCCXXV.

A supplement to an act entitled "An act to reorganize the local government of Jersey City," passed March thirtyfirst, one thousand eight hundred and seventy-one.

1. BE IT ENACTED by the Senate and General Assembly of the State of New Jersey, That the supplement, and each section thereof, approved April third, one thousand eight hundred and seventy-three, entitled "A further supplement to an act entitled An act to reorganize the local government of Jersey City, passed March thirty-first, one thousand eight hundred and seventy-one,'" which provides, among other things, that assessments for street and sewer improvements shall be paid at or before the expiration of five years after confirmation of the assessment, is hereby repealed.

2. And be it enacted, That hereafter, in advertising lands, tenements or real estate situate in said city, for sale for list of de- taxes, or water-rents, under the provisions and requirements of section one hundred and fifty-one of the act to which this is a supplement, and, under the provisions of any supplement thereto, the city collector shall, on or before the thirtieth day of June in each year, make a list or schedule of all the lands, tenements, or real estate on which the taxes due on the first day of January of the year next preceding, and the water rents due on the thirtieth day of June of the year next preceding shall remain in arrears, and shall cause said list, and a notice of the sale of the said lands, tenements, or real estate on the last linquents to Monday of August next, to be advertised in the official

newspapers once a week for three weeks next preceding said day of sale, which advertisement shall be set in tabular form, and in all cases where more than two lots belonging to the same delinquent owner are consecutively advertised for sale, the notice of sale of the same shall be condensed into one paragraph, making mention only once of the name of said owner, the individual, lot numbers, the block

number, the name of the street in which said lots front, the name of the map, the approximate aggregate area of said lots and the total amount of taxes or water rents due on all of said lots in one block, fronting on the same street; and it shall be lawful for said official newspapers to publish such portions of said advertisements from day to day, together with the general notice before mentioned, as may be necessary to secure the publication of the whole of said advertisement in the body of such newspapers within one week, and to make three weekly publications of the whole of said advertisement before the day fixed for said sale; provided, Proviso. that said newspapers shall be entitled to charge for only one publication in each week of the general notice or heading to said list above mentioned.

And be it enacted, That the notice required by section Notice by one hundred and fifty-two of the act to which this is a sup- how pubplement, shall conform to the provisions of section two of lished. this supplement, save that said notice shall be published by the city clerk in the official newspapers once a week for eight weeks, next preceding the first day of March in each year, and the cost of such advertisement shall be a lien on the property so advertised; the time allowed for redemption of lands, tenements or real estate sold for taxes or water rents as herein before provided, is hereby extended to the term of two years and six months from date of sale of the same, and that the sales for unpaid assessments required by section forty-six of a supplement to the act to which this is a supplement, approved March twenty-fourth, eighteen hundred and seventy-three; to be made on the first Mondays in April and October of each year, shall hereafter be made on the first Mondays of May and October, only of such lands on which an assessment has been confirmed for at least twelve months at the time of making such sale, and that no sale of lands, tenements or real estate as herein before provided, for taxes, water rents or assessments, shall be adjourned, except from day to day, until all the property is offered for sale, and that the city treasurer shall purchase for the city all property remaining unsold at the end of said sale, and that the time at which the collector is required to close out the tax levy, the yearly list of water rents or any assessment shall hereafter be within two weeks after the close of any sale as before provided.

how desig- Jersey City shall be designated by the board of finance and taxation from time to time, and said official papers shall be not more than four in number, and shall be the two daily newspapers published and circulated in said city; (provided that said two daily newspapers shall not belong to the same political party) which shall have had, for the period of six months prior to their designation as official papers, the largest bona fide average daily circulation in said city; the third shall be a weekly newspaper published in that part of Jersey City formerly known as Hudson City at least two years prior to and immediately preceding its designation as an official paper, and one weekly newspaper published in said city and printed in the German language, and which shall have been in existence and so published for at least the period of one year prior to its designation as an official paper; provided, that the newspapers heretofore designated and now being the official papers of said city, shall continue under such designation to be the official papers of said city until a new designation is made under the provisions of this section of this act.

5. And be it enacted, That if any tax assessment or water rent shall be paid by any person other than the owner, on any lands in Jersey City, through mistake or ignorance, when by agreement or by law the same ought to have been paid by the owner, it shall be lawful for the person paying the same to sue for and recover of such owner or other person who should have paid the same, the amount of such tax assessment or water rent, with interest and costs of suit, in any court having cognizance thereof, as so much money paid for the use of the person who ought to have paid the same, and the proof of such tax, assessment or water rent, and of the payment thereof, shall be prima facie evidence of the right of the plaintiff to recover in such suit.
