SIR: In compliance with Senate resolution of February 19th, I have the honor to inclose herewith a list of persons who have held appointments under the Department of Justice during the year 1879, together with the amount of compensation paid them in accordance with the law authorizing such appointments. I have not included in the list the names of those who have been employed under the department and paid from special appropriations, such as preparing the defense of suits in the Court of Claims, and the examination of official records and accounts. In my opinion the number of offices that have been provided for this department are not in excess of those required for the public service. Very respectfully,

Proceedings of board of survey on loss or damage of clothing suffered by certain men of Company K, Sixth Infantry, U. S. A., in their efforts to extinguish a fire at Fort Stevenson, Dak.

The Secretary of War has the honor to transmit to the United States Senate, for the consideration of the Committee on Military Affairs, the proceedings of a board of survey, from which it appears that certain men of Company K, Sixth Infantry, were sufferers by the destruction or damage of articles of their clothing in their efforts to extinguish a fire at Fort Stevenson, Dak.

Inasmuch as this loss of clothing resulted from personal efforts on the part of the men to save government property, and was incurred in the line of their duty, it is respectfully recommended that authority be granted to issue clothing in lieu of that damaged.

SIR: I have the honor to inclose herewith a copy of the proceedings of a board of survey, from which it appears that certain men of Company K, Sixth Infantry, were sufferers by the destruction or damage of articles of their clothing in their efforts to extinguish a fire at this post.

Inasmuch as this loss of clothing resulted from personal efforts on the part of the men to save government property, and was incurred in the line of their duty, I would respectfully request that necessary steps be taken for the relief of the men cited in the proceedings, that an extra issue be authorized, or that authority be granted to credit the men on their clothing accounts with the money value of loss incurred in each case, or that the matter be laid before Congress for its action. Proceedings of a board of survey convened at Fort Stevenson, Dak., by rirtue of the following order:

[Special Orders No. 87.]

HEADQUARTERS FORT STEVENSON, DAK.,

October 24, 1878.

A board of survey is hereby appointed, to meet at this post at 10 a. m. to-morrow, or as soon thereafter as practicable, for the purpose of ascertaining the loss to enlisted men of certain articles of clothing which were damaged or destroyed in the effort to extinguish the fire at this post on the 6th instant.

The board will report with a view to the reimbursement by the government for the actual loss of each man concerned.

The board met pursuant to the foregoing order. Present, all the members.

The board then proceeded to examine the affidavits of enlisted men (appended) in regard to the amounts of clothing damaged and destroyed by the fire.

It is within the personal knowledge of members of the board that, but for the energetic action of the men, the entire post would have been
