In law, more than in any other science, originality is not to be attained. Every principle in this book has been stated before, and perhaps stated better than it is here. The standard text-writers have been liberally con sultedfi Kent's Commentaries, Smith's Mercantile Law, Parson on Con tracts, and the California Codes, have been most freely referred to. The arrangement, the presentation of each subject, and the statement of principles are, however, new, and whatever of merit there may be in these is all that can be claimed for this book.
