CAPÍTULO II.

ART. 4. La soberanía en toda su plenitud existe radicalmente en la Nación, á la que compete el derecho exclusivo de establecer sus leyes, del modo que más adelante se expresará.

CAPÍTULO III.

ART. 5. La religión del Estado es la Católica Apostólica Romana. SECCIÓN II.

DE LA CIUDADANÍA, SUS DERECHOS, MODOS DE SUSPENDERSE, Y PERDERSE.

CAPÍTULO I.

ART. 6. Los ciudadanos del Estado Oriental del Uruguay son naturales ó legales.

ART. 7. Ciudadanos naturales son todos los hombres libres nacidos en cualquier punto del territorio del Estado.

ART. 8. Ciudadanos legales son: los extranjeros, padres de ciudadanos naturales, avecindados en el país antes del establecimiento de la presente Constitución; los hijos de padre ó madre natural del país, nacidos fuera del Estado, desde el acto de avecindarse en él; los extranjeros que, en calidad de oficia les, han combatido y combatieren en los Ejércitos de mar ó tierra de la Nación; los extranjeros, aunque sin hijos, ó con hijos extranjeros, pero casados con hijas del país, que, profesando alguna ciencia, arte ó industria, ó poseyendo al gún capital en giro, ó propiedad raíz, se hallen residiendo en el Es

ART. 2. The State is, and shall be forever, free and independent of all foreign power.

ART. 3. It shall never be the patrimony of any person or family.

CHAPTER II.

ART. 4. The sovereignty is vested fully and primarily in the Nation, to which the exclusive right belongs of enacting its laws in the manner to be explained hereafter.

CHAPTER III.

ART. 5. The religion of the State is the Roman Catholic Apostolic.

SECTION II.

CITIZENSHIP, ITS RIGHTS, SUSPENSION AND LOSS.

CHAPTER I.

ART. 6. The citizens of the Oriental State of Uruguay are either native or legal.

ART. 7. Native citizens are all free men born in any part of the territory of the State.

ART. 8. Legal citizens are: All foreigners, residing in the country previously to the establishment of the present Constitution, who are fathers of native Uruguayan citizens; the sons of native Uruguayan fathers or mothers, born outside of the State, from the date of their domiciliation in Uruguay; the foreigners who served as army officers in the armies of the Republic and fought its battles on land or sea; the foreigners with no children or with foreign children, who are married to Uruguayan wives, if engaged in some science, art, or industry, or in business, owning some capital, or real estate, and

CAPÍTULO II.

ART. 9. Todo ciudadano es miembro de la soberanía de la Nación; y como tal, tiene voto activo y pasivo en los casos y forma que más adelante se designará.

ART. 10. Todo ciudadano puede ser llamado á los empleos públicos.

CAPÍTULO III.

ART. 11. La ciudadanía se suspende:

1o. Por ineptitud física ó moral, que impida obrar libre y reflexi

vamente.

2o. Por la condición de sirviente á sueldo, peón jornalero, simple soldado de línea, notoriamente vago, ó legalmente procesado en causa criminal, de que pueda resultar pena corporal ó infamante. 3o. Por el hábito de ebriedad. 4o. Porno haber cumplido veinte años de edad, menos siendo casado desde los diez y ocho.

5o. Por no saber leer ni escribir, los que entren al ejercicio de la ciudadanía desde el año de mil ochocientos cuarenta en adelante.

6o. Por el estado de deudor fallido, declarado tal por juez competente.

7°. Por deudor al fisco, declarado moroso.'

CHAPTER II.

ART. 9. Every citizen is a member of the national sovereignty, and as such can vote and be voted for, in the cases and in the form to be hereafter designated.

ART. 10. Every citizen can be called to serve public offices.

CHAPTER III.

ART. 11. Citizenship is suspended:

1. By physical and mental disability to act freely and deliberately.

2. By the fact of being a domestic servant, or laborer, receiving wages, a private soldier, a vagrant, or subject to criminal prosecution liable to result in corporal or infamous penalty.

3. By habitual intoxication. 4. By being less than twenty years of age, unless married after reaching eighteen.

5. By being unable to read and write. This provision shall apply only to those who shall begin to exercise citizenship on and after the year eighteen hundred and forty.

6. By judicial declaration of bankruptcy.

7. By being a delinquent debtor to the Treasury."

3o. Expedir leyes relativas á la independencia, seguridad, tranquilidad, y decoro de la República, protección de todos los derechos individuales, y fomento de la ilustración, agricultura, industria, comercio exterior é interior. 4o. Aprobar ó reprobar, aumentar ó disminuir los presupuestos de gastos que presente el Poder Ejecutivo; establecer las contribuciones necesarias para cubrirlos; su distribución; el orden de su recaudación ó inversión; y suprimir, modificar ó aumentar las existentes.

5o. Aprobar ó reprobar en todo, ó en parte, las cuentas que presente el Poder Ejecutivo.

6o. Contraer la deuda nacional, consolidarla, designar sus garantías, y reglamentar el crédito público.

7°. Decretar la guerra y aprobar ó reprobar los tratados de paz, alianza, comercio y cualesquier otros que celebre el Poder Ejecutivo con potencias extranjeras."

8°. Designar todos los años la fuerza armada marítima y terres tre, necesaria en tiempo de paz y de guerra.

9. Crear nuevos Departamentos, arreglar sus límites, habilitar puertos, establecer Aduanas, y derechos de exportación é importación.

10. Justificar el peso, ley, y valor de las monedas; fijar el tipo y denominación de las mismas, y arreglar el sistema de pesos y medidas.

11. Permitir ó prohibir que entren tropas extranjeras en el territorio de la República, determinando para el primer caso el tiempo en que deban salir de él.

12. Negar ó conceder la salida de fuerzas nacionales fuera de la

4. To approve or disapprove, increase or decrease the budget of expenses submitted by the Executive power, to levy such taxes as may be necessary to meet said expenses, to provide for the distribution of these taxes, the order of their collection and disbursement, and to abolish, modify, or increase the existing ones.

5. To approve or disapprove, wholly or in part, the accounts rendered by the Executive power. 6. To contract the national debt, consolidate it, designate its guaranties, and regulate the public credit.

7. To declare war and approve or disapprove the treaties of peace, alliance, commerce and any others entered into by the Executive power with foreign nations."

8. To fix every year the strength of the land and sea forces which may be necessary in time of peace

or in time of war.

9. To create new Departments or Provinces, fix their limits, create ports of entry, establish customhouses, and order import and export duties to be levied.

10. To watch over the preservation of the weight, fineness and value of the national coin, fix the type and denomination of the same, and regulate the system of weights and measures.

11. To permit or forbid the transit of foreign troops through the territory of the Republic, determining in the former case the time within which they must leave the country.

12. To grant or refuse permission to the national forces to leave

13. Crear y suprimir empleos públicos; determinar sus atribuciones; designar, aumentar, ó disminuir sus dotaciones ó retiros; dar pensiones ó recompensas pecuniarias, ó de otra clase, y decretar honores públicos á los grandes servicios.

14. Conceder indultos, ó acordar amnistías en casos extraordinarios, y con el voto, á lo menos, de las dos terceras partes de una y otra Cámara.

15. Hacer los reglamentos de milicias, y determinar el tiempo y número en que deben reunirse.

16. Elegir el lugar en que deban residir las primeras autoridades de la Nación.

17. Aprobar ó reprobar la creación y reglamentos de cualesquiera Bancos que hubieren de estable

cerse.

18. Nombrar, reunidas ambas Cámaras, la persona que haya de desempeñar el Poder Ejecutivo y los miembros de la Alta Corte de Justicia.

CAPÍTULO II.

ART. 18. La Cámara de Representantes se compondrá de miembros elegidos directamente por los Pueblos, en la forma que determine la ley de elecciones, que se expedirá oportunamente.

ART. 19. Se elegirá un Representante por cada tres mil almas, ó por una fracción que no baje de dos mil.

ART. 20. Los Representantes para la primera y segunda Legislatura serán nombrados en la proporción siguiente: Por el Departamento de Montevideo, cinco; por el de Maldonado, cuatro; por el de Canelones, cuatro; por el de San José, tres; por el de Colonia, tres;

14. To grant pardons or amnesties in extraordinary cases, with the concurrence of at least twothirds of the members of each house.

15. To make rules for the government of the militia and determine its strength and the time when it should be called to service.

16. To select the place in which the highest authorities of the Nation shall reside.

17. To approve or disapprove the creation of banks and the rules made for their government.

18. To appoint, both chambers meeting in joint session, the person in whom the Executive power shall be vested, and also the members of the high court of justice.

CHAPTER II.

ART. 18. The Chamber of Representatives shall consist of members directly elected by the people in the form to be determined by the electoral law which shall be enacted in due time.

ART. 19. One representative shall be elected for each three thousand inhabitants or a fraction thereof not less than two thousand.

ART. 20. The representatives for the first and second sessions of Congress shall be appointed in the following proportion: For the Department of Montevideo, five; for that of Maldonado, four; for that of Canelones, four; for that of San José, three; for that of Co
