será discutido hasta la próxima Legislatura; pero si sólo se refieren á alguno ó algunos de sus artículos, quedarán éstos suprimidos, y el proyecto seguirá su

curso.

ART. 71. El proyecto de ley, decreto ó resolución, que fuere aprobado por ambas Cámaras, se enviará al Poder Ejecutivo para que lo sancione. Si éste le diere para sanción, lo mandará promulgar y ejecutar; mas, si se opusiere á ella, lo devolverá, con sus observaciones, dentro de nueve días, á la Cámara de su origen. Los proyectos que, en ambas Cámaras, hubieren pasado como urgentes, serán sancionados ú objetados por el Poder Ejecutivo, dentro de tres días, sin que pueda juzgar acerca de la urgencia.

ART. 72. Si la Cámara estimare fundadas las observaciones del Poder Ejecutivo, y ellas versaren sobre la totalidad del proyecto, se archivará, y no se renovará hasta la siguiente Legislatura. Si sólo se limitaren á correcciones ó modificaciones, podrá discutirlas, y resolver lo conveniente en un solo debate.

ART. 73. Á no acoger la mayoría de los miembros presentes las observaciones relativas á la totalidad del proyecto, la Cámara donde tuvo origen lo pasará, con esa razón, á la revisora, la cual, si las apreciare justas, lo devolverá para que se archive; pero si tampoco las hallare fundadas, á juicio de la mayoría de sus miembros, se mandará el proyecto al Poder

ART. 71. All bills or resolutions passed by the two chambers shall be sent for approval to the Executive power. If the approval is granted the bill shall become a law, and the Executive shall order it to be promulgated and executed; but if the approval is refused the Executive shall return the bill with his objections to the chamber where it originated within nine days. The bills passed by both chambers as urgent shall be approved or disapproved by the Executive within. three days, but the Executive shall have no power to pass opinion on the urgency of the measure.

ART. 72. If the chamber should consider that the objections of the Executive are well founded, and if said objections refer to the whole act, the latter shall be sent to the archives, and shall not be reintroduced until the next session of Congress. If the objections of the Executive refer to provisions which in its opinion need correction or amendment, the corrections or amendments suggested shall be discussed and disposed of in one debate.

ART. 73. If the majority of the members present refuse their assent to the objections made by the Executive to the whole act, the chamber where the bill originated shall refer it, with the proper explanations, to the other chamber. If the latter finds that the objections of the Executive are well founded, the bill shall be returned in order that it may be kept in the

ART. 74. Mas, si corriendo dichos términos, el Congreso hubiere suspendido ó clausurado las sesiones, deberá publicarse por la prensa el proyecto, y presentarse en los primeros tres días de la próxima reunión, con las objeciones hechas oportunamente. Si en el plazo de nueve días no se publicare con las objeciones, tendrá fuerza de ley.

ART. 75. Los proyectos que queden pendientes, ó sean rechazados ú objetados, se publicarán por la prensa, debiendo manifestarse la causa que haya impedido su sanción.

ART. 76. Los proyectos que pasen al Ejecutivo para la sanción, irán por duplicado, firmados ambos ejemplares por los Presidentes y Secretarios de las Cámaras, y con expresión de los días en que fueron debatidos.

ART. 77. Cuando el Ejecutivo notare que, respecto de algún proyecto, se ha faltado á lo dispuesto en los artículos 68, 69 y 70, devolverá ambos ejemplares, antes de tercero día á la Cámara en que se hubiere cometido la falta, para que, subsanada, siga dicho proyecto el curso constitucional; mas, á no encontrarla, deberá sancionarlo ú objetarlo, y devolverá á la Cámara

ART. 74. If the Executive does not return the bill, either approved or disapproved, within the period of nine days, or of three in cases of urgency, or if the Executive refuses his approval after all the constitutional requisites have been complied with, the act shall become a law. But if during the periods above stated Congress adjourns, either temporarily or finally, the act shall then be pubished in the newspapers, together with the objections thereto, and shall be introduced again during the first three days of the next meeting. If not published, together with the objections, within a period of nine days, the bill shall become a law.

ART. 75. All bills and resolutions upon which no action has been taken, as well as all those rejected or disapproved, shall be published in the newspapers, together with an explanation of the reasons preventing them from becoming laws.

ART. 76. The bills and resolutions sent to the Executive for approval shall be forwarded in duplicate, and signed by the presidents and secretaries of each chamber. They shall be accompanied by a statement of the days on which they were discussed.

ART. 77. If the Executive notes that the provisions of articles 68, 69, and 70 have not been complied with in regard to some bill or resolution, sent to it for approval, the two copies aforesaid shall be returned within three days to the chamber where the error was committed, in order that, said error having been corrected, the measure may go on through its

ART. 79. No es necesaria la intervención del Poder Ejecutivo en las resoluciones del Congreso sobre trasladarse á otro lugar, conceder ó retirar facultades extraordinarias, efectuar elecciones, admitir renuncias y excusas, proveer á su policía interior, ni en los actos que pueden ejecutarse por una sola de las Cámaras.

ART. 80. El Congreso en las leyes que expidiere empleará esta fórmula: "El Congreso de la República del Ecuador, decreta;" y el Poder Ejecutivo la siguiente: "Ejecútese "ú “Objétese.”

ART. 81. Para interpretar, modificar ó derogar las leyes, se observarán los mismos requisitos que para su formación.

ART. 82. Las leyes no obligan sino en virtud de su promulgación.

ART. 83. Serán promulgadas las leyes por el Poder Ejecutivo, dentro de los seis días subsiguientes al en que tienen fuerza de tales; y si pasado ese término, no las promulgare, lo hará también dentro de seis días el Consejo de Estado, bajo su más estricta responsabilidad.

ART. 78. If the chamber where the bill originated has adjourned, the days of the adjournment shall not be counted in making up the periods of time set forth in article 74.

ART. 79. The resolutions of Congress directing its sittings to be transferred to some other place, granting or refusing extraordinary powers, causing elections to be held, accepting resignations and excuses, or providing rules for its interior government, shall not require the intervention of the Executive. Nor shall said intervention be necessary for any act which can be executed by one chamber alone.

ART. 80. Congress shall use, for its laws, the following enacting clause: "The Congress of the Republic of Ecuador decrees." The form of approval or disapproval to be used by the Executive power shall be: "Let it be executed," or "Let it be objected."

ART. 81. The same rules which have been established for the enactment of the laws shall be followed for their interpretation, amendment, or repeal.

ART. 82. The laws have no binding force except by virtue of their promulgation.

ART. 83. The laws shall be promulgated by the Executive power within six days subsequent to their having become such; and if the said period is allowed to pass without the promulgation being made by the Executive, the council of state shall then make the said promulgation, within the following six days, under its strictest responsibility.

Podrán, sin embargo, restringirse ó ampliarse estos plazos en la ley misma, designándose otros especiales.

TÍTULO VII.

DEL PODER EJECUTIVO.

SECCIÓN I.

Del Jefe de la Nación.

ART. 84. El Poder Ejecutivo se ejerce por el Presidente de la República del Ecuador. Si faltare éste, le subrogarán:

1o. El Vicepresidente de la República.

2o. El último Presidente de la Cámara del Senado.

3o. El último Presidente de la Cámara de Diputados.

ART. 85. Verificada la elección de Presidente y Vicepresidente, el Congreso hará el escrutinio, y declarará elegido al que haya obtenido la mayoría absoluta, ó en su falta, la relativa. En caso de igualdad de votos, decidirá la mayoría absoluta del Congreso, por votación secreta limitada á los que hubieren obtenido igual número de votos en la elección popular. Si hubiere empate en el Congreso, se recurrirá á la

suerte.

ART. 86. Para Presidente ó Vicepresidente de la República, se requiere ser ecuatoriano de nacimiento y tener las demás cualidades que para Senador.

ART. 87. La Presidencia y Vicepresidencia de la República que dan vacantes por muerte, destitución, admisión de renuncia, imposibilidad física ó mental, y por cumplirse el término del período que fija la Constitución.

ART. 88. Cuando los destinos de Presidente ó Vicepresidente vaca

TITLE VII.`

THE EXECUTIVE POWER.

SECTION I.

The Chief Magistrate of the
Nation.

ART. 84. The Executive power is vested in the President of the Republic of Ecuador. In case of necessity the President shall be superseded:

1. By the vice-president of the Republic.

2. By the last president of the Senate.

3. By the last president of the Chamber of Deputies.

ART. 85. After the election of President and vice-president has been held, Congress shall count the votes and declare elected the candidate who obtained an absolute, or, if not, a relative majority. If the vote is equally divided, Congress shall decide by absolute majority and by secret ballot who is to have the office; but the choice has to be made from among the candidates who obtained equal number of votes in the popular election. If the vote of Congress proves to be equally divided the decision shall be by lot.

ART. 86. No one shall be President or vice-president of the Republic who is not an Ecuadorian by birth, and has not all the qualifications required to be a senator.

ART. 87. The positions of President and vice-president of the Republic become vacant by death, removal, accepted resignation, physical or mental disability declared by Congress, and expiration of the term established by the Constitution.

ART. 88. If the position of President or vice-president of the Re

Si para el término del período presidencial, sólo faltare un año, ó menos, el encargado del Poder Ejecutivo continuará ejerciéndolo hasta la conclusión de dicho período; y si faltare en igual caso el Vicepresidente, tampoco se procederá á nueva elección, y subrogará á éste, el último Presidente del Senado, y, en su falta, el último Presidente de la Cámara de Diputados.

ART. 89. El Presidente y Vicepresidente de la República lo son por cuatro años. No podrán ser reelegidos sino después de dos períodos. También se prohibe que, durante los mismos dos períodos, el Presidente sea elegido Vicepresidente, ó al contrario.

ART. 90. Ningún pariente dentro del segundo grado de consanguinidad, ó primero de afinidad del que se halla ejerciendo el Poder Ejecutivo, será elegido para reempla

zarle.

ART. 91. Al Presidente de la República ó al Encargado del Poder Ejecutivo no les es permitido ausentarse del territorio ecuatoriano sin consentimiento del Congreso, mientras ejerzan sus funciones, ni un año después.

ART. 92. El Presidente y Vicepresidente de la República, al tomar posesión de sus destinos harán la promesa siguiente, ante el Congreso: "Yo, N. N., prometo que cumpliré los deberes que me impone el cargo de Presidente de la República (ó Vicepresidente), con arreglo á la Constitución y las leyes."

public becomes vacant before the end of the constitutional period, the official in charge of the Executive power shall order, within the period of eight days, a new election; but this election shall be terminated within two months at the latest. The President or vice-president elected in this way shall serve only during the unexpired term of his predecessor.

If the unexpired term of the President does not exceed one year, the acting President shall continue in charge until the period expires. If at the time of the vacancy there is no vice-president, no election shall be held for that reason, but the last president of the Senate, and in his default the last president of the Chamber of Deputies shall be called to discharge the duties of the executive.

ART. 89. The President and vicepresident of the Republic shall serve for four years. Neither shall be reelected except after the expiration of two periods. During the same interval the President is disqualified from being elected vice-president, or vice versa.

ART. 90. No relative within the second degree of consanguinity or the first degree of affinity, of the Chief Magistrate, shall be elected to succeed him.

ART. 91. The President or acting President of the Republic shall not be allowed, during his term of office or one year thereafter, to leave the Ecuadorian territory without the consent of Congress.

ART. 92. The President and vicepresident of the Republic, on entering upon the discharge of their respective duties, shall make before Congress the following promise: "I, N. N., do promise to fulfill the duties imposed upon me by the office of President (or vice-president) of the Republic according to the Constitution and the laws.
