ART. 77. En la sanción de las leyes se usará de esta fórmula: "El Senado y Cámara de Diputados de la Nación paraguaya reunidos en Congreso, etc., decretan ó sancionan con fuerza de ley."

CAPÍTULO X.

De la Comisión Permanente. ART. 78. Antes de ponerse en receso las Cámaras se nombrará por cada una de ellas, por mayoría absoluta, una Comisión permanente, compuesta de dos Senadores y cuatro Diputados, nombrándose además dos suplentes por la Cámara de Diputados, y uno por el Senado.

ART. 79. Reunidos los titulares, nombrarán un presidente y vicepresidente, avisando al Poder Ejecutivo.

ART. 80. En caso que sea necesario llamar algún suplente, esto se verificará á la suerte.

ART. 81. La Comisión permanente durará hasta que se abran las sesiones ordinarias del próximo período legislativo.

ART. 82. Las atribuciones serán: Velar por la observancia de la Constitución y de las leyes, bajo responsabilidad ante las Cámaras.

ART. 83. Recibir las actas de elecciones de Diputados y Senadores, y pasarlas á la respectiva Comisión.

ART. 84. Podrá usar de la facultad que se confiere á cada Cámara en el artículo 67, Capítulo VII.

ART. 85. Convocará á sesiones preparatorias para examinar las

CHAPTER X.

The permanent committee. ART. 78. Each chamber before adjourning shall appoint by absolute majority a permanent committee, consisting of two senators and four deputies. The Chamber of Deputies shall also appoint two substitutes and the Senate one.

ART. 79. Upon the meeting of the members of the committee they shall elect their chairman and vice-chairman, giving notice thereof to the Executive.

ART. 80. If it becomes necessary to call a substitute, his designation shall be made by lot.

ART. 81. The permanent committee shall sit until the opening of the next ordinary session of Congress.

ART. 82. It shall be the duty of the permanent committee to watch over the faithful compliance with the Constitution and the laws and its failure to do so shall render it responsible before the chambers.

ART. 83. To receive the certificates of election of deputies and senators and cause them to be referred to the respective committees.

ART. 84. It shall use the power granted to each chamber in article 67, chapter VII, of the present Constitution.

CAPÍTULO XI.

ART. 88. En caso de enfermedad, ausencia de la capital, muerte, renuncia ó destitución del Presidente, el Poder Ejecutivo será ejercido por el Vicepresidente de la República. En caso de destitución, muerte, dimisión ó inhabilidad del Presidente y Vicepresidente, el Congreso determinará qué funcionario público ha de desempeñar su Presidencia hasta que haya cesado la causa de la inhabilidad, ó un nuevo Presidente sea electo.

ART. 89. Para ser Presidente y Vicepresidente de la República, se requiere ser natural de la República, tener treinta años de edad y profesar la religión cristiana.

ART. 90. El Presidente y Vicepresidente de la República durarán en sus empleos el término de cuatro años, y no pueden ser reelegidos en ningún caso sino con dos períodos de intervalo.

ART. 91. El Presidente de la República cesa en el poder el día mismo en que expire su período de cuatro años, sin que evento alguno que le haya interrumpido pueda ser motivo de que se le complete

más tarde.

CHAPTER XI.

The Executive power; its nature, duration, and election.

ART. 87. The Executive power of the Republic shall be vested in a citizen, to be called "President of the Republic of Paraguay."

ART. 88. In case of illness, absence from the capital, death, resig nation, or removal of the President, the Executive power shall be exercised by the vice-president of the Republic. In case of removal, death, resignation, or inability of the President and vicepresident, Congress shall determine which public functionary shall act as President until the inability ceases, or a new President is elected.

ART. 89. To be President or vicepresident of the Republic it shall be required to be a native of the Republic, thirty years of age, and to profess the Christian religion.

ART. 90. The President and vice-president of the Republic shall serve for four years and shall not be reelected except after the lapse of two presidential terms.

ART. 91. The President of the Republic shall cease to perform his official duties on the same day on which the four years of his term expire; and no event whatever which may have interrupted this period shall justify any attempt to complete it.

ART. 92. El Presidente y Vicepresidente disfrutarán de un sueldo pagado por el Tesoro nacional, que no podrá ser alterado en el período de sus nombramientos. Durante el mismo período no podrán ejercer otro empleo ni recibir emolumento alguno de la República.

ART. 93. Al tomar posesión de su cargo el Presidente y Vicepresidente prestarán juramento en manos del Presidente del Senado (la primera vez ante el Presidente de la Convención Constituyente) estando reunido el Congreso, en los términos siguientes:

"Yo N. N. juro solemnemente, ante Dios y la patria, desempeñar con fidelidad y patriotismo el cargo de Presidente (ó Vice) de la República del Paraguay, y observar y hacer observar, fielmente la Constitución de la Nación paraguaya. Si así no lo hiciere, Dios y la patria me lo demanden."

ART. 94. La elección del Presidente y Vice se hará por primera vez por esta Convención, como lo establece el artículo 127, y de conformidad con el artículo 100, y sucesivamente del modo siguiente: Cada uno de los distritos electorales nombrará por votación directa una votación directa una junta de electores igual al cuádruplo de Diputados y Senadores que envíe al Congreso, con las mismas calidades y bajo las mismas formas prescritas para la elección de Diputados.

ART. 95. No pueden ser electores los Diputados, los Senadores, ni los empleados á sueldo.

ART. 96. Reunidos los electores en la capital de los respectivos Departamentos dos meses antes de que concluya el término del Presi

ART. 92. The President and vice-president shall be paid out of the national treasury a salary which can not be changed during their term of office. Nor shall any of them hold any other position or feceive any additional pay or emoluments from the Republic during said term.

ART. 93. Upon entering upon the discharge of their duties, the President and vice-president shall take an oath, to be administered to them by the president of the Senate, (the first time by the president of the constitutional convention), and in the presence of Congress, in the following terms:

"I, N. N., do solemnly swear, before God and my country, to fulfill faithfully and patriotically the duties of President (or vicepresident) of the Republic of Paraguay, and to faithfully observe and cause others to observe the Constitution of the Paraguayan Nation. If I fail to do so, may God and my country demand it of me.

ART. 94. The election of President and vice-president shall be made, the first time, by the constitutional convention, in the manner provided in article 127, and according to the methods established in article 100 of the present Constitution. Subsequent elections shall be made as follows: each electoral district shall elect by direct popular vote a number of electors equal to four times the number of deputies and senators to which the district may be entitled in Congress, said electors to have the same qualifications as are required to be deputies, and to be elected in the same manner as has been provided for the latter.

ART. 95. No deputies, senators, or officials receiving salaries from the Government shall be electors.

ART. 96. The electors shall meet at the capital of the respective Departments two months before the expiration of the Presidential term,

Estas listas serán firmadas por los electores, y se remitirán cerradas y selladas, dos de ellas á la capital (una de cada clase) al Presidente del Superior Tribunal de Justicia, y otra al Presidente del Senado, en cuyos registros permanecerán depositadas y cerradas; quedando también el acta original sellada y cerrada en el juzgado de paz del distrito electoral.

ART. 98. El Presidente del Senado, reunidas todas las listas, las abrirá á presencia de ambas Cáma

Asociados á los Secretarios cuatro miembros del Congreso, sacados á la suerte, procederán inmediatamente á hacer el escrutinio y anunciar el número de sufragios que resulte en favor de cada candidato para la Presidencia y Vice presidencia de la Nación. Los que reunan en ambos casos la mayoría absoluta de todos los votos serán proclamados inmediatamente Presidente y Vicepresidente.

ART. 99. Para que este nombramiento sea válido, se requiere que haya habido elección por lo méños en los dos tercios de los Departamentos de la República, debiendo considerarse la mayoría absoluta de que habla el artículo anterior en estos dos tercios votantes, y no los de toda la Nación.

ART. 97. Two lists shall be made of all individuals voted for for President, and two other lists of those voted for for vice-president, with the number of votes cast for each. These lists shall be signed by the electors and after being closed and sealed transmitted (two of them, one of each class) to the chief justice of the superior court at the capital and another to the president of the Senate, in whose respective archives they shall be kept unsealed and in deposit. The original record of the election shall also be kept closed and sealed in the office of the justice of the peace of the electoral district where the election was held.

ART. 98. The president of the Senate after having put all the lists together, shall in the presence of the two chambers, open the envelopes containing said lists. Four tellers, elected by lot, shall assist the secretaries in examining, counting and announcing the number of votes obtained by each candidate for President and vice-president of the Nation. Those having, in either case, absolute majority of votes shall be immediately proclaimed President and vice-president.

ART. 99. In order that these elections be valid it is required that at least two-thirds of the Departments of the Republic have taken part therein, and the absolute majority referred to in the preceding article shall consist only of votes belonging to the two-thirds of the departments represented, and not to those of the whole Nation.

ART. 100. En el caso de que por dividirse la votación no hubiese mayoría absoluta, elegirá el Congreso entre las dos personas que hubiesen obtenido mayor número de sufragios. Si la primera mayoría hubiese cabido a más de dos personas, elegirá el Congreso entre todas éstas. Si la primera mayoría hubiese cabido á una sola persona y la segunda á dos ó más, elegirá el Congreso entre todas las personas que hayan obtenido la primera y segunda mayoría. Esta elección se hará á pluralidad absoluta de sufragios y por votación nominal. Si verificada la primera votación no resultase mayoría absoluta, lo hará segunda vez, contravéndose la votación á las personas que en la primera hubiesen obtenido mayor número de sufragios. En caso de empate se repetirá la votación, y si resultase nuevo empate decidirá el Presidente del Senado y por primera vez el de la Convención. No podrá hacerse el escrutinio, ni la rectificación de estas elecciones, sin que estén presentes las tres cuartas partes del total de los miembros del Congreso.

ART. 101. La elección del Presidente y Vicepresidente de la Nación debe quedar concluida en una sola sesión del Congreso, publicándose en seguida el resultado de ésta y las actas electorales por la

prensa.

CAPÍTULO XII.

ART. 100. In case the vote is divided and no absolute majority is obtained, Congress shall choose one of the two persons having the greatest number of votes. If this first majority belongs to more than two persons, Congress shall make its selection from among all of them. If the first majority belongs to only one person, and the second to two or more, Congress shall choose from among all the persons who obtained the first and the second majorities. The selection shall be made by absolute plurality of votes, and by yeas and nays. If it should happen that no absolute majority is obtained in the first ballot, a second ballot shall be taken, but the vote shall be confined to select from among the persons who in the first ballot obtained the greatest number of votes. If the votes are equally divided, the vote shall be repeated, and if equally divided again, the President of the Senate, and in the first election the President of the convention, shall decide. The counting of the votes shall not be made without the presence of a quorum consisting of three-fourths of the total number of members of Congress.

ART. 101. The election of President and vice-president of the Nation shall be completed in one and the same meeting of Congress, and the result of the election, as well as the electoral certificates, shall be published in the newspapers.

CHAPTER XII.

Atribuciones del Poder Ejecutivo. Powers and duties of the Executive.

ART. 102. El Presidente de la República tiene las siguientes atribuciones:

1. Es jefe superior de la Nación, y tiene á su cargo la administración general del país.
